MINUTES
COUNCIL WORKSESSION
The City Council of the City of Mason City, Iowa, met in Worksession pursuant to law and rules of said Council, in the Public Library, 1st Floor Classroom A at 6:00 P.M., on September 17, 2019. The meeting was called to order by the Mayor and on roll being called, there were present, Mayor in the Chair Schickel and the following Council Members: Masson, Jaszewski, Symonds, Lee, Thoma. Absent: Adams.
1. Discussion of upcoming CIP purchase of Fire Truck: Fire Chief Bullinger stated staff was looking at replacing a 36 year old engine that was taken out of service last year, advising they would like to purchase a new engine every 7 years which would then bring them up to industry standards where life expectancy was 10-15 years with a reserve engine of no older than 20 years. He pointed out they were currently at 12, 21 and 29 years old, noting Mason City was the only career department that ran engines over 25 years and had 2 of them. He mentioned they had applied for a Assistance to Fire Fighter Grant, but were unsuccessful. He mentioned the 29 year old truck was used as a rural truck around City limits, however it was set up entirely different than a City truck
Lee questioned how many engines were in the rotation with Bullinger stating 3 and there were also ladder trucks which they tried not to put mileage on and keep them in reserve.
Jaszewski inquired how long does it took to transition the rural truck with Bullinger stating one hour.
Thoma asked about the recent repairs with Bullinger stating over the past 4 years they had spent over $100,000 in repairs and expressed concern over possible failure during a call, adding that had happened, but luckily when it did shut down they recovered. He also mentioned there was a 3% increase each year for most manufacturers, so what he was considering was placing an order in October to avoid the 3% increase and lock in the price and then take delivery sometime in July or August (9 month build time)
Administrator Burnett also agreed there would be a considerable savings by ordering now and mentioned they did budget for the backfill not being in place so that helped with purchase ahead of next year and pointed out there were quite a few times when Mason City experienced down time on the trucks which put pressure on other areas like Clear Lake and Bullinger adding in the past 6 months they had notified Clear Lake that they were going to rely on them which left Clear Lake high and dry should they have an incident while the truck was in Mason City He further stated at one point they had 3 vehicles out of commission at the same time and over the winter spent the most on the newest vehicle which had 104,000 miles, emphasizing they were normally sold after 50,000 miles.
Lee asked about the City’s ISO rating with Bullinger stating they marginally missed getting an ISO 2 rating in 2017, advising ISO looked at pump capacity and what it could do and he believed the next ISO would bump up from a three to a two.
Masson asked why this wasn’t on the CIP with Burnett stating it was pushed to this upcoming year because of the number of competing resources, stressing it was a huge chunk of money and staff wasn’t sure if the backfill would be pulled out this year.
Masson questioned the gap and how much was the back fill with Burnett stating 50% of the payment required (when placing the order) would be $350,000 and explained they could allocate $200,000 from backfill and $150,000 from other sources, adding there were a lot of funds coming in pretty strong and thought they would be okay with Local Option Sales Tax.
Lee asked if they would be going with the same truck with Bullinger stating that truck wasn’t made anymore and with the last repair they had to look for parts in the junk yard.
Masson questioned procedure with Burnett stating it would be an Action Item on a future Agenda and the Council could elect whether or not to move forward, adding the level of need was high and they could get the truck at the beginning of the fiscal year which made sense.
Jaszewski asked when it would come forward with Bullinger stating the 2nd Meeting in October.
2. Update and Discussion of Nuisance Abatement and 657A Actions: Development Services Director Van Steenhuyse provided a power point presentation. He stated the Code Enforcement Division was involved in nuisance complaints and abatement, Housing Code Compliance, Rental Inspection and the Section 657A program and outlined what each of those duties entailed and the action and timeframes involved with respect to enforcement. He highlighted aspects of 657A which allowed cities to petition in District Court that a property was abandoned (in violation of the Housing Code or Building Code and vacant at least six months) with the hoped upon outcome being the Court would transfer the title to the City free of any liens or other encumbrances. He outlined some of the things the court took into consideration when determining whether a property had been abandoned. He also stated with regards to the 657A program the City was now working with the Lynch Dallas law firm who was experienced with these types of cases, adding there were 10 houses in the first round and 5 more pending attorney review, but stressed staff was focused on compliance and rehabilitation, the City did not want to own property. He then provided photos of the properties and advised as to the current status of each property.
Masson asked how many were finished without court action with Steven stating of all the cases only 2 went to court this year. All the rest were closed or in process and emphasized staff’s focus was on compliance and working with people.
Lee asked for a definition of “abandoned” with Van Steenhuyse stating generally it had been vacant at least 6 months.
Masson asked if there were any 657A’s this year with Van Steenhuyse stating last year was the first one, however with the transition to the attorney in Cedar Rapids he anticipated things ramping up.
Administrator Burnett stated disposal and sale to a responsible developer was important because staff did not want start back again at square one because they weren’t following through. Also, he stated he has had success with infill development, adding it wasn’t uncommon to have 2 blighted properties side by side and referenced the Iowa Prison Industry who was beginning to construct prefab homes that could go in those types of lots.
Lee questioned the City Code as it related to prefab homes and wanted to make sure that it was changed if it needed to be with Burnett concurring and reiterating the best thing was to rehab the homes, however many owners had unrealistic expectations of what they were going to accomplish.
Mayor Schickel inquired about the timeframe on the 10 houses discussed with Van Steenhuyse stating hopefully 2 would be completed before spring.
