Someone told me that some of the parade route was a candy free zone. Is this true?
Yes, the north-south route on Penn Avenue. The Chamber of Commerce took the candy away so band players don’t step on kids. Some are blaming the Blue Zone. With these whackos making decisions, who really knows.
@bad pontiac-yep, no candy in front of KIMT and there are no dogs allowed down town I believe from Friday through Sunday.
Good reminder to readers LVS. My dog and I went to the parade last year and a police officer, who was decent about it, informed me that no dogs were allowed along the route. I walked the dog home and then, because it was cold and rainy, I stayed home too and watched the parade from my ez chair. He explained that the pooch was a potential public safety concern.
The leaders in this town are more of a safety concern than any dog.
BTW. I wonder how many times Barney Fife gives a warning to the thugs who parade around a dog on a log chain in our fair city for a similar “potential public safety concern. infraction. Not often, not ever I bet.
I understand the thought. But I think it would be a real problem with all the children and other dogs with the thousands of people we get during the band fest. I think it is good to err on the side of caution. It is a big liability issue and the owner of a dog would have to pay if it bites someone and then yikes– their insurance rates would go sky high. Also, it’s bad enough with the horses pooping all over the streets… Add dogs and u have on smelly poop fest… YUKKKK!
Here’s how I see the county supervisor race in Cerro Gordo county:
Mike Grandon will win the democratic primary handily. And why shouldn’t he? He served as the county treasurer for 36 years and has an unblemished record. He’s my choice to win the final election. He’s the BEST candidate.
Gary Blodgett will win the republican primary. Gary isn’t running, you say? Oh yes he is. He’s just running under the name of Casey Callanan. If you vote for Casey you’ve sold out to Gary…
Casey Callanan I’m sure is a perfectly fine, and normal Iowa Human Being. His father Mike Callanan, who is the current At Large City Council Member appears as a very caring and reasonable human being. I’ve listened to him speak at the meetings many times. Slow, methodical and grateful to be in Clear Lake. The problem is the father moves at a snail’s pace, is resistant to change, one-sided on his approach, and favors friends and families over the entire body politic. Like Father…Like?

I was noticing comments on whether or not Supt. Anita Michich owns property in Cerro Gordo County. Neither her or her husband show up on the property search for this county. I have not checked other counties, or if it is in trust with another name. But, I think this is important. She is payed by our dollars and running ours schools into the ground. And, if she is paying no taxes towards the schools– that is just wrong!!!! Matt, can u investigate this a bit..Thanks.
She rents here in Mason City and I might be wrong, but I think her husband still lives in Des Moines.
I heard she is a renter here in the area. No purchase of property in MC or CL. Remember, she recently tried to leave for Nebraska. Selling a house or condo around here can be a major chore. Much easier to break the lease and move on.
That may be so, but it is fundamentally wrong on so many levels… This needs to be a story. She pays no taxes to the school district in which she gets paid by tax payer dollars….. And, whines about no money for the district….. Wrong Wrong Wrong….
The rent that renters pay completely covers property taxes. The landlord doesn’t pay that out of pocket.
Sure property taxes are paid on the property where she lives. But I think it’s the whole idea that she hasn’t made a commitment to Mason City by not having her own home that bothers people. She certainly could afford it. And it wouldn’t even have to be a house, there’s condos and town houses she could buy so she’s not responsible for lawn care, snow, etc. As far as I’m concerned, I would love to see Anita pack it up and leave.

With her salary and that of her husband Paul, they could afford to live in a home from $ 400 to 700K. Property taxes on a home of that caliber– would range from approximately, $ 4600 to almost $ 7,000 per year. To me it is the principle of the thing. I just saw the most outstanding statue uptown but it was put in the wrong location. It was a lone mule(jackass) but it needs about 7 more and put in front of the city hall to represent all the jackasses we have running our town. NOW THATS REAL FUNNY

@caffeine-I have heard the same thing. I also heard the Chinese Food store was going to close. That will leave the pretzel shop and Birdsels for food. There are 19 empty stores there right now and this will make 21.
The whispers around the mall are that Jitters, Hasey Asian Fast Food, Birdsall’s, Larson Red Zone Sports, Bookworld, and Jonathans are close to having to shut down. Further whispers are that the Subway in the mall is looking to relocate out of the mall. Even more whispers claim that if the mall losses so many tenants than Victoria’s Secret and Bath & Body Works would be forced to remove their stores due to their corporate rules mandating they be in a mall with a certain % of stores full.
Losing Jitters would be a serious blow to SBM. That affectively makes the south side of the mall pointless with zero buzz… however much buzz a coffee shop creates. The Chinese place has food that is on par with a frozen Hungry Man dinner. The Birdsall’s shop is an utter joke. Most times, the guy running it isn’t behind the counter. He might be in the back or maybe at the Y. The ice cream looks like it has freezer burn. No thanks. The cookies are gone. JC’s is limping along, and Eric wants to build a hotel on top of it. SBM has become a punchline and an embarrassment to MC, just like its elected leaders are.
Honestly I think that Bookie wants the mall to fail. Then he can talk his cronie council members, along with his elitist “friends” to try to use the mall for his arena he’s been wanting. Some people go out to the west side of town to shop and there’s not much there. And more and more people are going out of town to shop. The last time I went to Medford I saw quite a few people from Mason City there.
Right. Check West Des Moines for shopping. It’s like Indianhead with a facelift on steroids and growth hormone. Medford’s not in that class, but still an upgrade to MC. Just drive through the parking lots at the Indianhead mess. Mostly out of county license plates, lots of beat up, rusty cars with plenty of gravel dust caked on them. Classy. Trash bins overflowing. Who wouldn’t leave town to shop if this is the best MC has to offer? Anyway, hard to imagine what Eric is thinking. Truthfully, I believe most of the time he is pining for his next smoke and waiting for the next deal he can make that scores him points with someone who might give him money. The man is deranged and drunk with self-promotion. A real poison for MC.
Haven’t been to West Des Moines. That will be my next shopping trip. I can’t stand Walmart. I won’t buy clothes there. And as far as groceries, I either shop Fareway or Hy-Vee. The fuel savers are a big draw for me to go to Hy-Vee.
I agree. I never shop at Wal-Mart. I prefer Hy-Vee East. Best grocery store in town, and it’s not close.

@anon-I have heard that Victoria’s Secret has a company policy that if a mall falls below 75% occupancy they move out and because Bath and Body is a sister company they will move out too. The mall is below 70% now. What does that tell you?
Pasty white pretzels with salty cheese sauce, and ice cream. That’s a helluva Blue Zone combo there. Everything Eric touches becomes a joke and worse than it was before. But, that’s the way the people of MC like it, perhaps they were born to suffer under his buffoonery.
Say while I’m on, does ANYONE know where the activities for this weekend’s Band Fest are printed? Our local Chamber and Globe would be wise to print a little further ahead next time to inform the public so they can make plans to attend.
We had some out of towners looking to attend the evening bands and asked what they were. No one seems to know yet.
Maybe I’ll look in the Des Moines Register and see if they have.

Now that we have talked, I may send you something occasionally.
Maybe you can use some of this: An idea for you might be to examine how the Mason City Globe Gazette covers for and protects the NI Corridor (and MC city hall, and CG county). They recently wrote a story which is basically the opposite of your story today. I am paraphrasing, but the story said that the Clear Lake secrecy was perfectly acceptable. You can bet that every few weeks, the Globe will write a story parroting all the numbers the Corridor spews out about new jobs, millions in investment, etc etc. The Corridor takes credit for every job that ever came to MC to justify the pubic funding. The “big one” Willett landed in MC was WS Live, jobs that pay $9.50 an hour. The Globe is an agent of the Corridor, MC city hall, the courthouse supervisors and especially the MC Chamber of Commerce. Check the address of the Corridor and the MC Chamber. SAME BUILDING, owned by Chamber, at 9 North Federal in MC. That was built with $1.5 million in state funds. The Corridor pays about $26,000 in rent each year to the Chamber, which keeps the Chamber in the black. The last story the Globe did when Brent Willett resigned was that we could all expect a major new economic development to come to the area. Nothing has come of that, since. Their main writer who covers all this, John Skipper, has coffee with all the players in this soap opera, sits in their offices with the door closed, chums with them. Not to sound like sour grapes, but you probably know I ran for city council in MC last fall. They denied me a chance to come before their board with the other candidates. The other media – especially KGLO radio – operates similarly. They allowed the mayor, Eric Bookmeyer – to take a 3 minute rant on public radio against me. All on me. I have the recording. It was vile. I can let you listen to it. It was so bad they gave me 2 minutes of time to try to compensate for the damage he did. I understand that typically, journalists do not get involved in the political process, but I do what I do for certain reasons. There is no one here even trying to root out this corruption. Look at Bookmeyer, recently appointed to Vision Iowa Board… then Gov. Branstad, who made the appointment, is named MC Band Fest Grand Marshall. Unheard of to have political candidates take this role. Anyway, end of rant for now.
OK Matt-Maybe this will help get some action against the people that are controlling our city. Keep up the good work. The haters will be along shortly.

I heard through the grapevine that Jay Urdahl’s wife got a cushy job at NIACOG, where Jay sits on the board. Now they are both sucking off the tits of the taxpayers. I am cracking down on nasty attacks on other commenters. I heard something about Francis Lauer. That some of the kids haven’t been able to shower for a few days because there are no toiletry items available, and that they haven’t had hot water. I heard that they rely on donations for soap, shampoo, toothpaste, etc. Isn’t this facility run through either state or federal funding? My understanding is that the kids there have had issues with the law, drugs, truancy….and other problems.
But to not have necessary items for them to be clean and to not have functioning bathrooms is uncalled for. Felons in prisons have what they need, but a facility for kids doesn’t have necessities????? What’s going on? Maybe this is something NIT should look into.

The reason vets issues are considered contentious is because the decision to use lethal force against foreign powers has been morally disputed in the last 50 years, and for amp the last 250 years. I’ve said 3 factions should vote to go to war: the people, the congress, and the military themselves. By doing so, there would be less dispute and subsequently better treatment of vets post conflict. Bush squeaked by in his 2000 election, so his wars remain unpopular to this day.

Today was food drive day and the mailman was picking up donations. I don’t know about other neighborhoods but our mailman thanked us for the donation and told us we were about the only ones so far in this area that had given anything. If people were not to worried about animals that live better than a lot of people possibly they could give a little so people would have enough to eat.
I think feeding hungry kids is much more important that a damn elephant.

This is the first I have heard about it. Was is advertised at all? Wish I would have known I would have liked to have participated in it.
The United Way always sponsors the Stamp Out Hunger Day. And yes it wasn’t promoted very well this year. I received a card in the mail a few weeks ago but that was all I heard. I wish they would have done more, I’ve volunteered in previous years with it, and it’s always been pretty successful.
And, let me add that it seems that LVS is the voice of reason here…. I appreciate your trying to make sense of it all….

@Jerry-If I had to guess (and that is all I am doing here) I would say they are making a statement to all bike riders that they are to obey all the laws. I have seen bikers ride through stop signs (almost had one for a hood ornament the other day) Ride on the sidewalk, ride on the wrong side of the street, ride down the middle of the street, pull out in front of cars and so on and all this spring. They are trying to stop it before someone gets hurt or worse, killed. That is what laws are for.

An officer stopped me last year on my bike. I was on a well-lit street and it wasn’t dark. Called me in, made me produce ID. I though it was pretty asinine. But, that is how it works now. It takes little to stop a citizen and look for more infractions. The USA is not what it once was – not the fault of police – it is the fault of all of us for not doing our civic duty and voting, outing the political lunatics and crooks, and raising decent kids who respect others.
@Matt-In your case, and because it happened last year I would guess you were being targeted because of politics. At least that would not surprise me knowing who we have calling the shots in our city.

What does one do when they know someone that is a drug dealer and has never been caught? I’m sure the police know about them and how they earn their money. Isn’t it obvious when they can go to expensive restaurants, have expensive clothes and vehicles, but don’t really work. Is law enforcement just turning their heads or simply don’t care?

Why would I be jealous. I make an honest living. I would never want to be in the category of a drug dealer. I would rather be poor. I have small children, and would never risk losing them over drugs.

He raised corn, beans as well as a truck garden and milked 280 head of cows and had 450 head of hogs, had chickens and lot of kids. What is a 4th Amendment free world? I just read the amendment; it doesn’t say anything about a free world. Talks about probable cause before a search warrant is issued and only unreasonable searches are violations.

There is only one circumstance where anonymous tips should justify pullovers, and that is in the case of reporting abductions, especially child abductions. Everything else the police can follow the car around and wait it out until they witness the illegal action themselves, or until they can acquire a warrant. This ruling has huge potential for abuse.
Basically I will clause this by saying: Only Violent Crimes such as murders, abductions or imminent threats to security and safety of individuals and communities should be justifiable reasons to allow anonymous tips to facilitate pullovers. In other words, if no violent crime or abduction or illegal weapons are found in vehicle, any other crime such as drugs would not be admissible…and this includes any sort of interior requirement for vehicles the officer may notice missing.
That’s exactly how this new ruling will play out. Some cops themselves will be the ones who are going to abuse this ruling. I have nothing to hide but if this did ever happen to me my cameras will be recording every move they make and if it ends up in court for some reason my Lawyer will be asking for the initial reported call. I strongly believe in our rights which are slowly being taken away. To be honest its down right scary.
Smart move about the cameras. Audio should be included too. I would hope the reporting names must be recorded, but I see it’s near impossible when people call in anonymously.

Iowa law states you can video record in public without consent. You can NOT audio record without consent.
I know in casinos that they have to have a sign at the entrance that says audio and video is being recorded. We had to have a sign in our store stating that video was being recorded, not sure if it was a law to do this but we did anyway.

The system is broken, from the cops on the street, the judges on the bench, the probation/parole piece and especially those who make the laws that give more protections to law breakers than law abiding citizens.

Not trying to be harsh against police, but when aggravating comments are hurled my way, I get frustrated. The bottom line is that police DO NOT pull over or arrest people with illegal exhaust systems, yet they readily arrest simple marijuana possessions, and other types of crimes. I call it a double standard. I don’t care that DA’s supposedly have a difficult time winning convictions (I don’t believe it either), police can still step up the pressure. God knows they do on DUI’s.

That’s not exactly true. The traffic comes on its own by virtue of the exciting, hard-hitting, truthful stories NIT publishes everyday. NIT is running the Globe Gazette ragged as their entire staff tries to keep up, and many times, fails miserably. People love that, and pay to read about it. As far as Philo goes, I have been asked many, many times to “ban” him. I fail to see where he is a problem. All he does is post his opinions; he rarely attacks and if he does, it is in response to much worse personal attacks that come against him. I actually enjoy his perspectives even if I do not always agree. As far as banning those who are “threats” to NIT, again you are off-base. The man who has dedicated his life to shutting NIT down – the mayor of Mason City – is not banned here. He has always been welcome to answer for the criticisms leveled against him here. And, as a matter of fact, he has, occasionally, as when he admitted to NIT via email that he stole stamps and stationary from city hall. The mayor has conducted a long, nasty campaign to put NIT out of business, and even as he has struggles in that endeavor to this very day, I still never banned him. Usually, on the rare occasion an IP address is banned, it is because I find the comments are useless and not entertaining and without substance.

The latest Supreme Court ruling that will allow police to pull cars over based on a phone call alone, is unconstitutional regardless of what the Supreme Court says. Prior to this ruling police would need to witness a crime occurring themselves before being able to pull motorists over. This ruling is a violation of the 4th Amendment (Probable Cause). I sincerely hope police will require full names and addresses of the reporters. Getting interfered with by police for no reason sucks.
Police being able to kill citizens at will, and now this citizen reporting system, means the nation has entered into the beginning phases of the 3rd Reich, Stalin’s Russia, Mao’s China, Khomeni’s Iran, etc. It’s here folks. My family was really freaked out last night. A weird beat up car pulled in our driveway with its lights on and sat there and wouldn’t leave. We heard it because it was really loud even when it was idling. This was at 230 in the morning. Finally my husband went outside on the deck with a baseball bat to show them that they should leave. You should study this document and see that it matters how much visitation you have. There’s up to a 25% rollback if you have the kids a lot.

Child suppot should be based on a 40 hours per week and no overtime like Minnesota. I work overtime to get my boy a new bike and I ends up costing me more in the long run. Have kids almost 50% of the time and want to provide a good quality of life yet kids get up set because I have to shop a walmart for clothes and mom can by them 70 dollar shoes and I’m the bad parent. They don’t understand I’m buying those shoe. I could try to explain it to them but that is not fair to the childern
I will not put my kids in the middle. I’m not going to make them choose between parents. That is not what there should have to do. I just feel the hike support laws need to be reviewed and come up with some better way of coming to the dollar amount. One other thing, I is crazy to put fathers or mothers in jail because of child support. I only adds to the problem. Try finding a good paying job with that on your record after loosing your jobs because of being in jail.

I wish I got that much in support, my ex is ordered to pay $123 a month, barely pays that, refuses to help out with extras like school expenses, says that is what child support for.

Clearly if you were served papers your NOT paying your child support. It ALSO means your up to 3+months behind on payments. You could pay pocket change each month and the state would stay off your back and see it as you TRYING. I know this because I am one of the MANY not getting support payments for their children. Since this is the whiners den, I’ll tell you what else bugs me. It’s all the people who complain about government spending and people on food support, then turn around and insist well jail people for pot and every other small time infraction at a cost of $40,000 a year. What’s more is that when someone leaves prison for a felony they are asked if they want to apply for SSI? First we pay $40,000 a year and then we make them dependent for life because they can’t get a job.

If loud exhaust systems were confined to motorcycles and not trucks and cars, and if the motorcycles would refrain from opening throttle in residential or downtown areas, I would agree with your statement Pastor Man. LAVORATO, Justice.
Richard N. Tompkins Jr. pleaded guilty to the crime of trespass in connection with an incident in which he unlawfully entered a residence searching for women’s undergarments with which to sexually gratify himself. The plea led to disciplinary proceedings against Tompkins in which the Grievance Commission found that he violated Iowa Code of Professional Responsibility for Lawyers DR 1-102(A)(1) (violating disciplinary rule), (3) (engaging in illegal conduct involving moral turpitude), (6) (engaging in any other conduct adversely reflecting on fitness to practice law), and EC 1-5 (failing to refrain from all illegal and morally reprehensible conduct). Four members of the commission recommended that Tompkins’ license to practice law be suspended for not less than three months while one member recommended a reprimand.
After reviewing the record de novo, see Iowa Sup.Ct.R. 118.10, we agree with the commission that Tompkins was guilty of these ethical violations. However, we are convinced the circumstances of this case warrant a suspension of not less than two years. See id. (“Upon such review de novo the court may impose a lesser or greater sanction than the discipline recommended by the grievance commission.”).
Tompkins began practicing law in Mason City in 1976. At that time he also became a part-time assistant county attorney. In 1978 he was elected county attorney of Cerro Gordo County and held that position until January 1983. Thereafter he entered the private practice of law and has continued in that endeavor.
Beginning in 1977, Tompkins, by his own admission, entered a number of homes and apartments in the Mason City area without the residents’ permission. He gained access in various ways. In numerous instances he entered through unlocked doors. Sometimes he used keys left with him by friends. At other times he would slip locks with a credit card or knife. The homes were usually those of people he knew.
Once inside, Tompkins would search for the undergarments of women residents so that he could use the garments for sexual gratification. Sometimes he would stay on the premises; at other times he would take the garments elsewhere.
Tompkins chronicled these unlawful entries in a sworn statement given to the Cerro Gordo County Attorney in January 1986. Under questioning by the county attorney, Tompkins admitted entering, in this manner, well over one hundred homes.
Tompkins’ modus operandi included entering homes whose residents he knew would be away. On the occasion he was caught, he miscalculated. The time was November 1985. Tompkins observed a neighbor pass him on a highway. Believing no one was at her home, Tompkins drove there, found the back door unlocked, and proceeded to the basement in search of her undergarments. Once there, he was confronted by her husband. Although at first refusing to disclose why he was there, Tompkins ultimately admitted his purpose.
Seven months later, Tompkins pleaded guilty to a misdemeanor charge of criminal trespass in connection with the incident and received a suspended thirty-day jail term. Thereafter, a complaint against Tompkins, based upon these numerous illegal entries, was filed with the commission.
In the hearing before the commission, Tompkins readily admitted the ethical violations. But, in a skillfully presented case designed to meet our concerns in Committee on Professional Ethics & Conduct v. Vesole, 400 N.W.2d 591 (Iowa 1987) (three-year

suspension for misdemeanor convictions of indecent exposure, disorderly conduct, and public indecency), Tompkins offered convincing medical testimony regarding his present fitness to practice law. Tompkins’ fitness to practice law is, of course, a prime factor in our determination of an appropriate sanction. See id. at 593.
At the hearing before the commission, Tompkins presented as witnesses Dr. Ronald M. Larsen, a psychiatrist, and Ms. Bobbie Hurst, a clinical psychologist, both of whom have been treating Tompkins since December 1985. Both described Tompkins’ affliction and his recent efforts, by way of treatment, to control it.
Both experts diagnosed Tompkins as having a psychosexual disorder characterized as fetishism (the use of nonliving objects as a method of achieving sexual excitement) and voyeurism (repeated observation of unsuspecting people who are naked, in the act of disrobing, or engaging in sexual activity, with no sexual activity with the observed person or persons being sought). Although Tompkins’ medical history reports acts of voyeurism, both experts testified that this disorder has not been part of Tompkins’ behavior for thirteen years. According to Tompkins’ medical history, his disorder began with a childhood incident characterized by Hurst as a sexual trauma. Neither expert felt that Tompkins was likely to be sexually assaultive or agressive to others.
After extensive psychological testing of Tompkins conducted by Hurst, Larsen recommended a two-part treatment program: intensive inpatient treatment, followed by prolonged outpatient treatment under Hurst’s supervision. At Larsen’s suggestion, Tompkins, in the latter part of February 1986, went through a three-week inpatient treatment program in a Minnesota hospital. There he was assigned to a specific sexual dependency unit similar to specialty units for alcoholic treatment. The inpatient treatment was directed at controlling obsessive behavior, much like a treatment program for alcoholics.
After completing his inpatient treatment, Tompkins began his outpatient treatment under Hurst’s care in the latter part of March 1986. The treatment consisted of psychotherapy one hour per week. As of the time of the hearing before the commission, Tompkins was still in outpatient treatment. Throughout this treatment, Tompkins also saw Larsen, who acted as Hurst’s supervisory psychiatrist.
The thrust of the inpatient and outpatient treatment was to teach Tompkins how to stop the offensive behavior. He learned and practiced techniques to reduce his sexual fixation. In addition, he was taught to identify and cope with situations (prolonged stress; prolonged moods of anger, fear, and anxiety; alcohol; drugs; interpersonal conflicts; marital conflicts) in which he would be at high risk to repeat the offensive behavior. Finally, he was trained to avoid situations that might cause him to relapse. The treatment is presumably having its desired effect because no evidence of similar offensive behavior since the incident in question was presented.
The prognosis offered by Larsen and Hurst was very optimistic, based upon Tompkins’ education, intelligence level, and primarily, his response to treatment. The two experts opined that the chances were negligible (five percent) that Tompkins would repeat his behavior.
From Tompkins’ testimony we learn he continually practices the thought-control techniques he learned in treatment to avoid relapses. He has also adopted preventive measures for the same reason, such as making himself accountable to someone, either his wife or his secretary, for all of his time. In addition, he has joined a support group which meets weekly. Tompkins described several stressful situations he experienced since treatment and how he was able to cope with them without falling back into his old habits. Tompkins assured the commission that treatment has worked for him and that he will continue with therapy in one form or another for the rest of his life.
Both experts felt that an additional six to nine months of intensive weekly psychotherapy was needed. Beyond that, Larsen recommended that Tompkins be monitored

for the rest of his life. By that recommendation, the doctor meant Tompkins should maintain a doctor-patient relationship throughout his life to continually reinforce the techniques he has learned to control his behavior. Underlying this recommendation is the doctor’s belief that Tompkins’ sexual disorder can never be cured but only controlled.
We recently recognized that “moral turpitude” is a term that has defied clear definition by the courts. Committee on Professional Ethics & Conduct v. Patterson, 369 N.W.2d 798, 801 (Iowa 1985). But we cited approvingly this definition:
Perhaps the best general definition of the term “moral turpitude” is that it imports an act of baseness, vileness or depravity in the duties which one person owes to another or to society in general, which is contrary to the usual, accepted and customary rule of right and duty which a person should follow.
Id. (quoting Committee on Legal Ethics v. Scherr, 149 W.Va. 721, 726-27, 143 S.E.2d 141, 145 (1965)). The numerous acts readily admitted by Tompkins easily meet this definition. Accordingly, we, like the commission, conclude that Tompkins clearly violated DR 1-102(A)(1), (3), and (6), and EC 1-5. See Vesole, 400 N.W.2d at 592 (attorney’s indecent exposure on three occasions violated DR 1-102(A)(3), (6), and EC 1-5); Committee on Professional Ethics & Conduct v. Floy, 334 N.W.2d 739, 740 (Iowa 1983) (attorney’s two obscene phone calls violated DR 1-102(A)(3) and (6)).
Having concluded Tompkins acted unethically, we turn to the difficult question in this case: what sanction is justified in these circumstances.
We have said on numerous occasions that
[a]ttorney disciplinary proceedings are not designed to punish, but rather to determine the fitness of an officer of court to continue in that capacity, to insulate the courts and the public from those persons unfit to practice law, to protect the integrity of and the public confidence in our system of justice, and to deter other lawyers from engaging in similar acts or practices.
Vesole, 400 N.W.2d at 593; Committee on Professional Ethics & Conduct v. Borchart, 392 N.W.2d 491, 492 (Iowa 1986); Committee on Professional Ethics & Conduct v. Rogers, 313 N.W.2d 535, 537 (Iowa 1981). Moreover, we have recognized that a particular sanction must be tailored to the facts of each case. Vesole, 400 N.W.2d at 593; Borchart, 392 N.W.2d at 492.
Whatever sanction we deem appropriate, we must not overlook the serious nature of Tompkins’ conduct, which bears directly on his fitness to practice law. It should go without saying that the more egregious and persistent the conduct, the more debased the character of the offender, and Tompkins’ conduct was both egregious and persistent. By his own admission, Tompkins stealthily entered over one hundred residences, in many instances while he was serving as county attorney. He attempted to rationalize his actions by suggesting to himself, at the time, that he was not hurting anyone. What he was ignoring, however, was the possibility that serious injury or death could have resulted from the surprise and trauma of his illegal entries into people’s homes. As a county attorney he should have been acutely aware that even family members have been killed or seriously injured because they were mistaken for burglars.
Further, we do not agree with Tompkins’ experts that the compulsiveness of his illness should serve as a mitigating factor. See Vesole, 400 N.W.2d at 592 (compulsive personality disorder does not absolve attorney from responsibility for his misconduct). They admit, as does Tompkins, that he knew what he was doing. Thus, the experts ignore the fact that Tompkins knew he could get help for his problem but chose not to do so until faced with dire consequences.
Moreover, we agree with the committee that Tompkins’ illegal conduct during his tenure as county attorney is particularly egregious. The reprehensible nature of such acts by a public servant should have been most apparent to Tompkins. One

might ask why he would knowingly break the very laws he, as county attorney, was sworn to uphold. Of course, the same question could be asked about why he, simply as a lawyer, would put himself in such a position. We might ask ourselves how the public can have confidence in our system of justice if we overlook or minimize knowing and willful criminal conduct by a person who was, at the time, not only an officer of the court but also an elected official responsible for enforcing our criminal laws.
Finally, we must satisfy ourselves that Tompkins is a “recovered sexaholic,” as his psychiatrist and psychologist suggest. We were not satisfied of this in Vesole. This lack of satisfaction, together with the evidence of a high rate of recidivism (at least twenty-five to fifty percent) for the particular disorder (exhibitionism), the aggressive actions of Vesole towards his victims, and Vesole’s repeated conduct even after his first conviction, accounted substantially for the stringent sanction of a three-year suspension. Id. at 592-93. Of course, in these circumstances, protection of the public is of vital concern to us.
The conduct in this case is so egregious that we could justifiably revoke Tompkins’ license or impose a stringent suspension similar to that in Vesole. We choose not to do so for several reasons. Our careful review of the record satisfies us that, though not cured, Tompkins has indeed recovered to the point that he probably does not pose a threat to the public. As long as he continues to practice the techniques he has learned to control his behavior, it seems unlikely that Tompkins will return to his old habits. Unlike Vesole, Tompkins, once caught, has not repeated the offensive behavior. Moreover, Tompkins has demonstrated a commitment to a lifelong term of psychiatric care to help him in his endeavor to avoid a relapse. Finally, as for deterrence, we are not convinced that revocation or a stringent sanction similar to that in Vesole, in these circumstances, would deter lawyers with similar disorders. More likely, such a sanction would encourage these lawyers to hide their disorders rather than admit them and seek treatment.
After carefully considering and balancing all these considerations, we are convinced that a two-year suspension, in these circumstances, is justified. Any longer period would be more punitive than protective. In addition, we believe the sanction is stringent enough to underscore the seriousness of the conduct and to reflect our continuing resolve to the public that the courts will maintain the ethics of our profession. See Committee on Professional Ethics & Conduct v. Halleck, 325 N.W.2d 117, 118 (Iowa 1982).
We therefore suspend Tompkins’ license to practice law in the courts of this state indefinitely, with no possibility of reinstatement for two years from the date of this opinion. This suspension applies to all facets of the practice of law. See Iowa Sup. Ct.R. 118.12.
Upon application for reinstatement Tompkins shall establish that he has not practiced law during the suspension period and that he has in all other ways complied with the requirements of our rules pertaining to suspended attorneys. See Iowa Sup. Ct.R. 118.13. Any application for reinstatement shall be accompanied by satisfactory evidence that Tompkins (1) has not engaged in any similar acts of misconduct since the date of the hearing before the commission, (2) has received all outpatient treatment contemplated by his psychiatrist and psychologist, and (3) is continuing his commitment to lifetime psychiatric care. If Tompkins does apply for reinstatement, the court may appoint an independent psychologist or psychiatrist to evaluate Tompkins’ condition. Costs are assessed to Tompkins pursuant to Iowa Supreme Court Rule 118.22.

Once again I found my Sunday newspaper sopping wet on my doorstep, this being the 4th time I have had an issue with delivery in the 4 months that I have had a subscription. Change is difficult and the ones who sit at the top of a lop-sided world want to protect what little they have. LVS, Buzz and the others have ZERO to contribute. No offense taken. It’s unfortunate the ethic in this region isn’t reflected in a way that fits my values. However, there are many people who are miserable here, and wish it were different. Lots of policies, and characteristics that are working against that though. I think some people somewhere appreciate my efforts. They may be quiet about it, but they are out there reading. Hard to get back the wall of crud you demons constantly are building on NIT.
Despite my other comments, I have come to the conclusion this website is more toxic than it is helpful. Out of compulsion I stayed to try and “win”. There is no winning here. IT only serves to pull you down. I do believe that I’m finally finished. There is nothing further here.

I concur cultural “norms” are very difficult to transcend. Status Quo is a form of laziness. He said the same thing about me and I have told him over and over again that I have no problem at all with medical marijuana but I do not condone ILLEGAL drugs and I am against recreational pot all the way. Brosephus is correct: When did it become wrong to be able to discuss a subject whether the topic is legal or illegal in America…supposedly the land of the free? How do you suppose something becomes illegal or is made legal again? That happens because issues are discussed. The strategy of people like LVS, and the others is to stop or stifle conversation about any issue they don’t agree with. They have no intention of honoring healthy debate. They only want to exert their position.
If a law is so absolutely rock solid, it would obviously be able to withstand the test of debate, and any scrutiny put upon it. But when it comes to marijuana discussion, LVS, Crumcutter and many others on NIT refuse to allow the topic to even be discussed. This suggests they aren’t certain of whether marijuana should be legal or illegal. Take murder for example. I could easily discuss why murder should be kept illegal and I wouldn’t fear debating anyone as to why.
Peter, it’s not that they are trying to stop the conversation. It’s that the only things you argue about is legalizing drugs and making loud pipes illegal. We are just tired of the same thing over and over again.

Lucy, it doesn’t matter if ‘State’s Rights’ was the mantra in the past, if it serves these people on an issue to have strong Federal oversight (such as for keeping marijuana illegal), they will call for it. I watched Fox news slam the military when Obama won, and just a few months prior, they endlessly praised it. Fed, or State’s Rights, pro military, or peace activist, means nothing when they are rabidly trying to force or keep their agenda over on the Status Quo. No reasoning with them
