MASON CITY – A ten day stay in the Cerro Gordo County Jail for violating a no-contact order may not have been enough to deter a Clear Lake man from doing it for at least the fifth time.

Daniel Lee Franken, age 24, is now accused at least five times of violating a no-contact order with a Mason City woman. He was booked into the Cerro Gordo County Jail Sunday morning after 1:30 AM on the latest accusation. He was soon released on his own recognizance.

Franken is accused of felony domestic assault involving strangulation against the alleged victim – who is from Mason City and is the protected party in the no-contact order he allegedly violated again Sunday morning.

On April 19, Franken was charged with trespassing and violating a no-contact order with the protected party.  Franken was found guilty by judge Patrick Byrne of contempt of court and sentenced to 10 days in jail, which Franken then served from April 19 to April 29.

Franken is now awaiting a July 29, 2014 trial on the felony charge of domestic assault. A pre-trial conference has been scheduled for July 18th.
