Mason City man gets prison for 4th domestic abuse conviction

A Mason City man will serve up to 5 years in prison following sentencing in class “D” felony 3rd or subsequent domestic abuse assault case.

37-year-old Robert Michael Ferch was arrested December 3rd, 2011 after Mason City police responded to a domestic argument at 625 Tyler Ave North in Mason City. As a result law enforcement arrested Ferch a resident of the address for domestic abuse assault.

Ferch was charged with felony 3rd or subsequent domestic abuse assault as a result of previous convictions. Ferch had been convicted of domestic abuse assault in January and again in March of 1999 in Cerro Gordo County. Ferch was also convicted of domestic abuse assault in Story County in July 2001.

While awaiting trial Ferch was arrested by Mason City police for violating a protective no contact order and 2nd offense possession of marijuana on February 3rd.

Ferch has been held on bond since being picked up on a warrant on Febuary 9th for violation of pre-trial release.

Court records show he entered a voluntary negotiated plea of guilty in the case on March 30th along with entering a guilty plea to the 2nd offense possession of marijuana.

At the scheduled sentencing hearing on Monday, May 7th, District Court Judge Stephen P. Carroll sentenced Ferch to serve up to 5 years in prison for the 3rd or subsequent offense domestic abuse assault. Judge Carroll dismissed a $750 fine but orders Ferch to pay $1205.55 in court costs and reimbursement for his public defender.

In accordance with special legislation to address habitual domestic abusers after the 3rd offence Iowa Code 708.2A-6b states Ferch “shall be denied parole or work release until the person has served a minimum of one year of the person’s sentence.”

Robert Michael Ferch is currently listed on the Cerro Gordo County Inmate Population report as awaiting transport to prison.

Just to let you all know that he had more domestics in Floyd County and also hit his own 2 year old!!!

I wonder why these assulters get THAT many 2nd chances before they do go to prison. I have been a victim of an abuser and in my opinion there should be no 2nd chance. A batterer is nothing more than an adult bully.

if you do domestic abuse you go to jail.
shoot or kill someone you get to go to BeeJee.
he should have shot and killed someone so he would not have to go to a real jail

That seems to be the problem in this town, oh do a different crime. How about stop committing crimes all together.
