Jason Genzler sentenced to 25 years in prison

MASON CITY – Jason Glenn Genzler, 34, was sentenced in court today in Mason City to 25 years in prison.

Genzler plead guilty to a class B felony vehicular homicide involving operating while intoxicated following a one-vehicle accident that took place on May 12, 2012 at 3:15 AM near 20759 Spruce Avenue.

According to Iowa State Patrol, John Lybarger, age 33, was killed when the 1997 Dodge pickup he was riding in lost control. The Dodge went into the west ditch, rolled and came to rest on its top. Minda Jones, age 32 and Genzler were injured in the accident.  Genzler was later arrested and charged in the incident.

Genzler must pay $150,000 restitution to Lybarger’s estate as well, prosecuting attorney Steve Tynan told NorthIowaToday.com.

“It will be up to the parole board how long he serves,” Tynan said. He said that in cases like this one, inmates – if well behaved – get “double credit” for each day that passes while they are incarcerated.

Genzler is now in the Cerro Gordo County Jail awaiting transport to Oakdale Classification Center in Coralville.

Peter L is right yet again.

@Peter L.-you are not comparing apples to apples. The is a big difference between making a mistake while driving and delibertly driving after drinking. Anyone can make a mistake and most people do at some point. If I had to guess I would say Ms. Streets was probably distracted by the children and missed the sign. That does not excuse her for violating the law but it does say what she can be penalized for.

I was comparing apples to apples. the judge usually has a range they can give for many sentences. In the two latest cases for some reason the judge decided to give a higher sentence for some reason. while in other cases as read here on NIT, judges allow plea bargaining to be done. I guess you can beat up someone and get out faster than driving drunk.

@Peter L.-I tend to agree with your statements. I don’t know how it will ever happen but the concept is good. I have a little bit of a gripe. If someone drives a car drunk and has a accident and the passenger is killed they throw the book at the driver. If the passenger is a minor I would agree with this. If the passenger is a adult and has been out drinking with the driver I think they should be responsible for their own actions. In other words, if they know the driver has been drinking they should refuse the ride. People no longer want to accept responsibility for their own actions.

i agree with you Peter L. when someone has knowledge that they are committing a crime, then the punishment should be higher.

You should look at the sentencing options allowed by the Code of Iowa, laws passed by the Iowa Legislature, before complaining about unequal treatment. Most of your complaints should be directed at the legislature. The judges don’t have discretion in most felony sentencing.

I know someone who got less than 1 year for the very same thing.

Was Nicole Streets driving while impaired? If not, that is the difference in sentencing.

@Jesus-driving while intoxicated could mean he was high on pot or some other illegal drug.

Drinkers…put that in your pipe and smoke it.
