Mason City man on probation for bashing windshield evades violation after theft conviction

MASON CITY – In yet another taste of “justice” in Cerro Gordo county, a man who bashed a windshield and made police chase him – leading to his conviction for criminal mischief and a probation punishment – is guilty of theft but so far faces no probation violation.

On the afternoon of August 21, 2016, Mason City police were called to Mills Fleet Farm, 3200 4th Street SW, as a detained shoplifter – 25-year-old Cole Arthur Pearce – awaited their arrival. He was arrested on a charge of third-degree theft and taken to the county jail. He posted $2,000 cash bond and was soon released. He and his public defender entered a not-guilty plea in October. However, a warrant for his arrest was issued on December 27 when he skipped a pre-trial conference. Cops soon caught him and took him to jail, and he then pled guilty to aggravated misdemeanor third-degree theft. He was given a suspended 2-year prison sentence, a suspended fine, and sent to the Beje Clark halfway house for 180 days, along with 2 years of probation.

Pearce was notified that he was banned from the Mason City Walmart by employees following an un-described incident there on January 27, 2015. No criminal charges were filed at that time. Then, on January 9, 2016, Pearce was confronted by Walmart employees who attempted to detain him for shoplifting a tablet and gaming accessories worth over $200.00. Pearce ran from the employees and jumped into a waiting vehicle that drove him away. They caught him later and charged him with third-degree theft. He later pleaded guilty and was ordered to pay $1,155.75 in fines and court fees in that case, plus another third-degree theft charge netted him another $1,170.75 in fines and court fees. Records show he never paid a dime on either balance.

Earlier in 2016, Pearce was found guilty of criminal mischief in connection to another incident. Police say that on February 20, 2016, at 7:17 PM, officers were called to 325 5th Street NW. The caller reported someone had broken a windshield and damaged a parked car at this location. The damage appeared to be over $1,000 but less than 10,000. The suspect, Pearce, soon returned to the area but then took off running from police. Police were able to apprehend him a short time later. Pearce was charged with 2nd Degree Criminal Mischief, Criminal Trespass, and Interference with Official Acts. He later took a plea deal. The criminal mischief charge was changed to third-degree and the other charges were dismissed after his guilty plea. He was given a suspended 2-year prison sentence, a suspended fine, and 2 years of probation. Records show that no action has been taken against Pearce as to a violation of his probation, despite his recent guilty plea (conviction) for third-degree theft.

Seriously f#$k these judges. I was a victim of his awhile ago. I’ve not received a dime, or justice. He’s been on probation for 10 god damn years. I got a speeding ticket, my first one 6 months ago and paid a higher price then this douche.
