Citing “grave concerns” for public safety, Iowa appeals court upholds sentence of Mason City drug dealer

DES MOINES – A man who was arrested numerous times in the Mason City area for drug offenses and other violent crimes and later sent to prison has lost his appeal in court.

Kenneth Donjuare Alfonzo May appealed his sentences imposed by the district court, contending the district court did not provide adequate reasoning on the record. However, the Iowa court of appeals found that the district court properly exercised its discretion and provided sufficient reasons for May’s sentence.

On June 28, 2013, May was charged with eight serious charges after a tense stand-off with police days earlier, on June 21. In a plea deal, May pled guilty to four of the offenses on September 13, 2013. He pled guilty to possession with intent to deliver (marijuana), possession of a firearm or offensive weapon by a felon, possession of dogs for dog fighting, and failure to affix a drug tax stamp, all class “D” felonies. The remaining counts were dismissed.

May was sentenced on November 4, 2013. The State recommended May receive a term of incarceration not to exceed five years for each of the four charges, with the terms for possession with intent to deliver and failure to affix a drug tax stamp running concurrently to each other and consecutive to the other terms, for a total term of incarceration not to exceed fifteen years. The State explained the basis of its recommendation, stating, “[E]ach of these charges, with the exception—exception of the ones that the State’s asking to run concurrent to each other, are entirely different charges. They aren’t related in any way, and it—the State has grave concerns for the safety of the community and society as a whole.”

On June 21, 2013, the North Central Iowa Narcotics Task Force executed a search warrant at 554 6th S.E. in Mason City, with the Special Operations Group Tactical Team. While executing the warrant, May, who resides at this residence, jumped out of a 2nd story window and fled on foot. May was apprehended hiding in an outside crawl space after a brief standoff at a residence in the 500 block of 5th S.E by officers, and then charged, leading to his trial and prison sentence.
