REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on May 16, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Symonds, Thoma, Lee. Absent: Adams.

Adopt Agenda: Motion, Masson; Jaszewski that the agenda be adopted. AYES: All (Motion carried.)

The Mayor proclaimed the week of May 14-20, 2023 as “National Police Week in Mason City” and the month of May, 2023 as “Tourism Month”.

City Administrator Burnett presented his Monthly Activity Report. Council comments and questions followed.

Consent Agenda: Regular and Work Session Minutes of May 2, 2023; Claims dated May 4 and 11, 2023, in the amount of $3,234,235.14; Plaza Mexico – Class C Liquor License, Catering Privilege; Las Palmas Restaurant – Class C Liquor, Outdoor Service; Wild Bill’s Billiards – Class C Liquor, Outdoor Service; Music Man Square – Catering Privilege, Class C Liquor; Mason City Brewing – Class C Liquor , Class A Beer, Outdoor Service; Resolution No. 23-100, levying assessments for charges on certain properties and the certification of same to the County Treasurer for collection with property taxes; Resolution No. 23-101, approving the purchase of a Hydro-excavation Truck from Mid Iowa Solid Waste Company of Johnston, Iowa for the Operations and Maintenance Division; Resolution No. 23-102, approving the purchase of a backhoe from Ziegler Inc. of Mason City, Iowa for the Water Utility Division; Resolution No. 23-103, approving the purchase of a Microwave Solids Analyzer from CEM Corporation of Matthews, North Carolina and one Muffle Furnace from Midland Scientific of Davenport, Iowa for the Water Reclamation Division; Resolution No. 23-104, approving contract and bond for the “2023 Street Rehabilitation Program Project No. 23-1001”; Resolution No.23-105, award of contract to Heartland Asphalt, Inc. of Mason City, IA for the Surface Transportation Block Grant Program Federal-Aid SWAP Project No. STBG-SWAP-4833(646)—SG-17 (Winnebago Way 12th Street NE Street and Utility Rehabilitation Project); Resolution No. 23-106, authorizing approval of the supplemental letter agreement with Short Elliott Hendrickson, Inc. for additional services related to the Winnebago Way _12th Street NE Street and Utility Reconstruction – SWAP; Resolution No. 23-107, approving an Amendment No. 1 to the Professional Services Agreement with WHKS & So. for additional services related to the Destination Iowa Trail Improvements; Resolution No. 23-99, ordering a public hearing on the proposed vacation and conveyance of public property needed to accommodate the revised roadway alignment of U.S. 65/South Federal Avenue and approval of the Iowa Department of Transportation Purchase Agreement and issuance of Quit Claim Deed,; Resolution No. 23-108, approving Final Plat for “Beck’s First Subdivision” within two miles of the Corporate City Limits of Mason City, Iowa; Resolution No. 23-109, proposing vacation and conveyance of public property (alley) in the block bounded by 26th Street SW, S. Jefferson Avenue, 27th Street SW and vacated S. Madison Avenue in Mason City, Iowa as set out in this resolution below; and calling for a public hearing on the proposed vacation and conveyance; Resolution No. 23-110, authorizing approval and execution of a second Assignment and Assumption Note and Mortgage regarding 2019-2021 South Federal Avenue; Resolution No. 23-111, authorizing approval and execution of a second Subordination; Resolution No. 23-112, establishing the Vacant Building Registration Fee Structure in the City of Mason City, Iowa; Resolution No. 23-113, setting date for public on designation of the Expanded Forest Park Economic Development Area and on Urban Renewal Plan Amendment. Motion, Jaszewski; 2nd, Symonds that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

Illinois Bridge Improvement (Destination Iowa) No Action Required: The recommendation is that the Illinois Bridge Improvement Project documents be revised with a 2024 completion date and readvertise later this year. The City of Mason City advertised for bids for the Illinois Bridge Improvement Project. The bids were due on Tuesday, May 9, 2023, with a public hearing scheduled for May16, 2023. Although there was a show of interest in the project, based on the plan holder’s list (seven prime contractors requested plans), no bids were submitted for the project. The City’s consultant, WHKS, reached out to several of the contractors following the advertised time for the letting to gather comments and feedback on the lack of bidding. Those responding stated their schedules were nearly filled, and they would not be able to meet the completion date. They would most likely have submitted a bid for the project if it were a 2024 project. To keep the project in the que, the logical alternative is to make minor revisions to the advertising and contract documents and release the project for rebidding toward the latter part of 2023, with the project being completed in 2024. No action is required.

“Scrip Road Conversion” (Destination Iowa): The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Lee; 2nd, Symonds that Resolution No. 23-114 adopting plans, specifications, form of contract and estimated cost for the “Scrip Road Conversion Project” and 23-115, making award of contract to Heartland Asphalt of Mason City, Iowa for the “Scrip Road Conversion Project”, be adopted and the bid tabulation bid tabulation with recommended bid from Heartland Asphalt, Inc. of Mason City, Iowa in the amount of $428,172.57, be accepted. Discussion followed regarding how Scrip road would be blocked off and the parking situation and what surface it would be. AYES: All (Motion carried.)

FY 23 Budget Amendment #2: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Thoma that Resolution No. 23-116, amending Budget (#2) for fiscal year ending June 30, 2023, be adopted. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:40 p.m.
