Man injured falling from top of railcars, then arrested

MASON CITY – Mason City police say today that a passer-by called police Monday morning at about 6:50 AM after hearing a person yelling for help in the area of the railroad tracks at 9th Street and South Carolina Avenue.

Officers located Noe Guiterrez, 42, no permanent address, inside a railroad grain car, injured and unable to get out.  Mason City fire medics were called to the scene and transported Guiterrez to Mercy Hospital.  He claimed to be walking on top of the cars last night in the dark and fell through an open hatch, where he remained for several hours.

Guiterrez was charged with trespassing on railroad property resulting in an injury, a serious misdemeanor and riding on or inside a railroad car, a simple misdemeanor.

The MCPD reminds the citizens that is it illegal to be on railroad property.  Trespassing on railroad property is a serious misdemeanor in some cases and is punishable by up to 1 year in jail and up to a $1,875 fine.

Give the guy a break, all he wanted to do it get home (Mexico) as would anyone with any sense if they live in or near Mason City!

GREAT DAY, for the city, 400-500 dollars in fines, just for helping someone out of the train car. Now thats profit

He got the fine because he was trespassing on private property. If he wouldn’t have been somewhere he wasn’t suppose to be then he wouldn’t have gotten a fine.

I wonder if they bothered to check if he is a US Citizen or could he be one of those “illegal aliens.”

Whoops, there I go profiling. Now I am just not politically correct. But what the heck, maybe he just needs a ride home.

He is not an illegal alien. His parents live in Mason City and are very nice people. He has “health” issues. He is lucky someone heard him and he didn’t die.

This guy is in and out of jail all the time, so obviously he doesn’t have any regards for the law anyway!!

And it still doesn’t deter people from walking on railroad property, especially right by the tracks. A locomotive weighs 200 tons, and an empty rail car weighs 30 tons. The average freight train weighs in at roughly 5,000 tons, or 1,000,000 pounds. They can’t stop on a dime, let alone a football field (under normal circumstances). A train and/or rail cars can move at anytime, in any direction, yet people continue to cheat injury and death each and every day by running gates, crossing through or under equipment, and roaming railroad property.

Rail cars cannot move in any direction. They can only move in the direction of the rails. If you cannot detect and avoid something that weighs that much and is quite frequently blowing a horn that could wake the dead, you get what you deserve.

Trains don’t use there horn 100% of the time, especially in yard limits, which Mason City is for both the U.P. and the C.P. Rail cars move when you least expect it! The slack from the locomotive pulling or pushing the cars happens quickly. To clear up what James was saying because your a smartass, they can move forwards or backwards at anytime without warning! If your on top, under, or between the cars, it is very easy to get thrown off, ran over, or both resulting in serious injury or death! So, how about everyone use some common sense, trains move faster than you think! Looks are deceiving…Look, Listen, Live

I agree and will add, stay the hell out of where you shouldn’t be.
