MASON CITY – A Mason City man who was charged with a felony after firing a bullet at another man who had broken into his home and assaulted him has struck a plea deal.
Troy Oglesby, 45, was charged with felony C terrorism after a July 4th, 2012 incident that took place at his home in southwest Mason City. Ogelsby was allowed to strike a plea deal today in court and has plead guilty to carrying a dangerous weapon, an aggravated misdemeanor. He will be sentenced at a later date, but the prosecuting attorney, from Hancock County, recommended 60 days in jail with 45 suspended and 1 year of probation, along with community service.
According to Oglesby, he was asleep at his home at 1614 South Harding Ave. at about 3 AM on July 4th when his front door was kicked in by a man known by Oglesby. The intruder proceeded to strike Oglesby with a sledgehammer, which he had also used to break out windows on Oglesby’s van.
Oglesby proceeded to chase the man out of his house and fired a gun at the man, who was getting into a car that had other people in it. No one else was injured except Oglesby.
Oglesby had faced upwards of 17 years in prison before the plea deal was struck.
Oglesby said after court today “tell all my supporters thank you.” He also said “the criminals eluded justice … karma will catch them.”
Oglesby also claimed today that the FBI has been contacted due to what he is calling “corruption” in the Mason City Police Department and that the FBI is now investigating.

ok first of all i lived with troy for how long? because he made me. there is no way my brother go into that house. troy has a security system on the door, a new york lock which is a long piece iof wood wedged up underneath the doorhandle, a medal rod across the door, and the lock thats on the nadle. there is no way that kaleb got in there. and troy sleeps on the couch which is no more than 5 steps away from the door. and he is a very light sleeper.

So he did threw her clothes and pushed her out the door because he was worried. She has a temper and got very mouthy. She then called her mom to come and get her. Rarely did his daughter’s mother come & take her for any amount of time as she lived with Troy’s mother. As for Anne Tyler, she NEVER did. Didn’t call, visit nothing! When I was home caring for my mother while Troy’s daughter lived there. I received a phone call from the school saying she was sick & needed to come home. I asked if they had contacted her mother. They said yes, she can’t get her because she’s working. I got into a huge text with Mandy. She refused to go get her sick daughter. Troy was working out of town by Cedar Rapids. I ended up picking her up, taking her to the doctor, she was very sick. Ended up on 4 different medications. I informed her mother what was going on. She works less than 1 mile from the house. She never stopped by to even check on her daughter. Anne Tyler never called once the entire 3 months I was home caring for my mother. So “Anonymous” you don’t know jack. The reason Oglesby is still alive is because Tyler missed his mark & hit him in his side. Why weren’t they made public? They were shown to the DA & court. 1. A person commits the offense of operating while intoxicated if the person operates a motor vehicle in this state in any of the following conditions:
a. While under the influence of alcoholic beverage or other drug or a combination of such substances.
b. While having an alcohol concentration of .08 or more.
c. While any amount of a controlled substance is present in the person, as measured in the person’s blood or urine.
It is exactly same as driving a car. You are legal until you cannot pass a field sobriety test and/or your BAL level is .08 or more.
This is from a legality standpoint, I’m not saying it’s a good idea to practice this.

Troy Was sleeping on his couch with his head elevated as 3 weeks before the attack he had; had surgery on his head and was heavily medicated. that’s why he thought he was hearing fire works when they were busting the windows out of his van and then his front door flew open glass flew all over. He stood up and got hit with the slug hammer and got knocked back on the couch. he had his pistol laying on top of the couch he then grabbed it and fired. Calob ran to the street yelling to his friends he’s got a gun. As he ran he dropped the slug hammer. His adrenaline was going so hard he couldn’t think. as far as shooting into the car, there has never been any proof. he asked to see the evidence, but never got to. He called the police himself and they came out to investigate. The very next day a swat team came up both ends of the street and up the alley, and put him in hand cuffs and took him to jail. they put him on a 10,ooo.00 bond.They took the slug hammer which had Dave and Calob Tylers names on it Troy took pictures of it and the door.Troy did not get hit in the head he got hit in the side, which left his whole side black and blue.he has pictures of everything. He has asked council several times to bring all this evidence to the court but it never happened. He had no way of fighting them and it was to far into the case to get another lawyer. HE tried. One lawyer from New York said Calob should have been charged With attemted murder. The fight is not over. thanks to all of troys supports.

If you read the original NIT article about this crime from last year, an individual who uses the name of Wally Norton wrote that he personally witnessed Troy Ogelsby and Todd Blodgett sitting together at the same bar in Clear Lake on the day after this happened. Just a short time before Ogelsby tried to murder these kids, Blodgett threatened to kill a carnival worker with his gun. This group of violent gun crazies must be investigated and exposed. Public safety depends on stopping these bloodthirsty, trigger-happy rednecks. I am calling the Sheriff right now and shall contact the County Attorney in the morning.

I live in a real world, where there exists a reasonable expectation of being safe when one walks down a street. That includes being safe from the potential of someone firing a gun down a street.

Those comments are based on fact where possible, law, on the thought that society must be regulated in order to be free, on the fact that I cannot, and do not know everything, and most others share the same fate. @peter L.-they love to use the terrorism charge because it is the most severe charge there is next to murder or kidnapping. That way they can start high and the pea bargain down to what they really think the charge is. All it does is make the police look stupid and drive up legal cost. There are no city fathers. What does that even mean. We have a bunch of average people calling shots that benefit themselves and friends. There is no such thing as city fathers. That was the guy who founded the city 150 years ago and he’s dead.
Let’s not forget that a key point in this story is when Mr. Oglesby fired the shot at the assailant, said assailant was already OUTSIDE Oglesby’s residence and running away, therefore the assailant was no longer a threat to Oglesby’s life. Under Iowa law Mr. Oglesby committed a felony at that point. However, under the circumstances I believe the justice system cut him a really good deal on the plea bargain. They very well could have put him away for 17 years and made a felon out of him for life. I can certainly sympathize with Mr. Oglesby and the situation that led up to the shot being fired. I can’t say that I wouldn’t want to react the same way. Word of advice, in the event of a similar situation, keep the gun closer and hand so the shot can be made while the assailant is still within the confines of your home. Also, practice, practice, practice!! 😉 Judicious marksmanship is a must. Could be one less asshat criminal on the streets.
How do you know the guy wasn’t running to his car to get a gun, a knife, or more people to help him? You assume he was no longer a threat- how can you assume this when he attacked Mr. Oglesby with a deadly weapon? What makes you think the attacker was all through?
I assume nothing of the sort, but since the attacker was fleeing from the residence and was OUTSIDE of said residence when the shot was fired, he was no long a threat at that time. Mr. Oglesby should have made an attempt to secure his residence and call the police for assistance… but stand his ground should anything else transpire. IF the attacker returned with another weapon or more people THEN there is a call for deadly force. According to Iowa laws, he was in the wrong when that shot was fired. Until Iowa adopts the Castle Doctrine, gun owners protecting themselves have to be very careful how they protect themselves.

If you think that desiring a society where one does not have to worry about guns being fired about with wanton disregard for others, equates a “sheeple”, then you obviously have a delusional idea of freedom.
A traditional conservative supports the concepts and ideals of our Constitution which establish freedom. It does not mean taking guns away from everyone. It does mean putting limits on society to protect the good of the whole. It means limiting if need be, who can own guns, and who cannot. It means limiting how a gun is used.
I believe, and rightfully so, that no society will last very long, without limits. Limits in this particular case, means a disrespect for the rest of a neighborhood, or community, by using a gun when it is clear the threat for the moment has passed.
No reasonable member of society would think it proper to chase a person, who at that moment, is not a threat, and fire a gun in his direction. It makes no difference if you were firing from your property or not. It is the risk that others could be in the crossfire. It is the disrespect for the lives of other innocent people.
It is clear in this case, that the person who perpetrated the assault no longer had a weapon when he fired down the street. There might have been another weapon in the vehicle he got into, but it was not displayed, nor used. Thus, there was no longer a threat where deadly force should have been used.
Courts around our country have all reached the same conclusion I might add (citations available upon request). You can defend your property. You can defend your life within reasonable means. But you cannot endanger the lives of others in the process.
Mr. Oglesby did just that firing his gun down a street.
The law is clear, when you kill an innocent person, it is murder. The law does not allow exceptions for a person which claims to have been defending themselves, and kills an innocent person.

I cannot explain the case against the chap with the sledge hammer. Nor can I guess what is in the case files and police reports. I give credit to the system. Why, because in any kind of organization, when a big decision has to be made, there always needs to be authorization from a higher level.
In the case of our police, a mere report from the officer on the scene will not suffice. Not only will a shift commander sign off on it, but undoubtedly, his boss as well. If an investigator was involved, same for his work.
Then you have the Prosecutor. They have to account to their boss in the end. This his or her boss must sign off on it. Judges, the whole system has checks and balances since there has to be accountability.
Those documents are public record. If people are so concerned, why have they not sought them out?

Who was the intruder and did they get charged with anything?
The intruder was Kaleb Merle Tyler, grandson of Dave Tyler, retired MC police officer and Ann Tyler, Secretary in the county attorneys office. Kaleb wasn’t charged with anything at first. Troy called (recorded)the detective who was working on the case repeatedly asking for them to charge him and the first time he told Troy he had to talk to his captain first. Then the rest of the calls were ignored.
Finally in November they charged him with third degree criminal mischief. He then threatened to kill Troy again and was put in 5East for awhile. Troy was called by a MC police officer and told this.
He got one year probation and 625.00 fine. No restitution on the damages done to Troys vehicle and home.
And still some idiots cant understand why people consider taking the law into their own hands.

Dori, I fully support your brother’s right to defend himself with a firearm but Observer is correct, once the criminal was fleeing from the scene and was outside of your brother’s residence, he lost all the right he had to fire that shot. It was a dangerous decision that could very well have put an innocent person at risk. Thankfully that didn’t happen. I’m also glad that your brother received a plea agreement. Under the circumstances, I more than likely would have wanted to react the very same way. Iowa law clearly states that what transpired was, in fact, a felony. I know it sucks, but be thankful that the justice system was lenient and allowed the plea agreement; your brother could have been locked up a for long time and be a felon for the rest of his life. Not trying to be a jerk, just trying to be the voice of reason.

One of the issues with this case is that Troy got a terrorism charge. He was asleep in his house. He did not seek anyone out to do them harm. And Kaleb gets a slap on the hand. He should have been charged with terrorism, Attempted murder, burglary. Troy is happy with the outcome of today. But something still needs to be done about Kaleb being protected every time he breaks the law. He was in the north end liquor store robbery, keyed a teacher’s car, plus other crimes.

As a gun owner and a concealed carry permit holder, I do agree that what Mr. Oglesby did was wrong since the immediate threat to his life ended as soon as the assailant left his residence. I do not agree that the judgement give everyone permission to take random pot shots down city streets; Mr. Oglesby IS being punished and I hope that he will learn a lesson about responsible gun ownership. Thankfully, his actions didn’t hurt an innocent person. I’m sure that if they had, the judgement would be much different.
John_Bender, no one knows how they will react to an attack. Your instincts are to defend yourself. Clarity isn’t always instant. Shock, injury and fear come into play. Adrenaline is rushing through your body. These are all factors in Oglesby’s reaction to a violent situation. The fact that the law is how it is, based upon firing a gun in city limits is what it is. However, there is no certainty on how anyone would handle this type of attack. Oglesby’s intentions where to defend himself. Nothing more. Tyler’s intentions were CLEAR. Tyler went there with intent to do great bodily injury or murder. He first stopped at his grandparents home to get the sledgehammer & proceeded with his plan. Premeditated.
Thank you Peter. For the last 10 months we have contacted more people than we can count starting with the Iowa Attorney General with replies of, “sorry there’s nothing we can do for you”. I don’t plan on giving up. Although today came out well, the others involved should have been charged. That’s where the corruption plays in. We did find out that Ann Tyler is no longer employed at the County Attorney’s office. Maybe bringing too much attention to them? Mason use to be such a great town. Too bad it’s been ruined.
