A Mason City woman who was just released last Thursday from the Cerro Gordo County Jail after being picked up on a warrant for failure to appear to court in relation to a driving while suspended incident that happened December 11th is back behind bars again.
According to the Cerro Gordo County Sheriff’s daily incident report 28-year-old Nichole Sue Merino was pulled over Sunday afternoon near the corner of Federal Ave North and 14th Place NW in Mason City by a member of the Cerro Gordo County Sheriff’s Department.
While being processed into the jail for driving while suspended and littering Merino assaulted two correctional officers. Nichole Merino was then charged with two additional serious misdemeanor counts of assault on a peace officer and placed in a holding cell.
A person convicted of an serious misdemeanor faces a maximum of one year in jail and a $1,875 fine.
Court Records show Merino is currently on probation after being found guilty this year in both Franklin County and Blackhawk County of felony thefts in the 2nd degree. Merino has a five year suspended prison sentence in both cases that could be imposed if she is found to be violating probation by committing more crimes.
