U.S. Citizenship and Immigration Services once again accepting applications for deferred action under DACA

WASHINGTON, D.C. – U.S. Citizenship and Immigration Services says it is once again accepting applications for deferred action under DACA.

Deferred action is a discretionary determination to defer a removal action of an individual brought to the United States as a child of illegal aliens.  This is as an act of prosecutorial discretion.  Deferred action under Deferred Action for Childhood Arrivals (DACA) does not confer legal status upon an individual and may be terminated at any time, with or without a Notice of Intent to Terminate, at DHS’s discretion.

Due to the recent federal court order, U.S. Citizenship and Immigration Services (USCIS) has resumed accepting requests to renew a grant of deferred action under DACA. Until further notice, and unless otherwise provided in this guidance, the DACA policy will be operated on the terms in place before it was rescinded on Sept. 5, 2017.

Individuals who were previously granted deferred action under DACA may request renewal by filing Form I-821D (PDF), Form I-765 (PDF), and Form I-765 Worksheet (PDF), with the appropriate fee or approved fee exemption request, at the USCIS designated filing location, and in accordance with the instructions to the Form I-821D (PDF) and Form I-765 (PDF). USCIS is not accepting requests from individuals who have never before been granted deferred action under DACA.  USCIS will not accept or approve advance parole requests from DACA recipients.

Conservative elected leaders like President Donald Trump and Iowa Congressman Steve King have railed against DACA, which protects from deportation people who entered to the U.S. as illegal alien children. There are, reportedly, as many as 780,000 people (“dreamers”) or more in the program right now. According to a U.S. government web site on the DACA program, “On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of two years, subject to renewal. They are also eligible for work authorization. Deferred action is a use of prosecutorial discretion to defer removal action against an individual for a certain period of time. Deferred action does not provide lawful status.”

Trump, gave the program – championed by former President Barack Obama – 6 more months from September, 2017, before he pulls it.

“DACA was a free ride signed into law illegally by Obama,” Trump said in September. “Illegal immigrants paying ZERO taxes are reaping the benefits Americans can’t.”
