MASON CITY – A Mason City burglar who was caught in the act last year as he invaded a house but got only probation and restitution is facing the prospect of further punishment at a hearing this month.
A known Mason City crook – 27-year-old Joshua Schaer – invaded a home owned by Troy Elwood at 1126 1st Street SE at about 10:18 PM on August 28, 2014, and was discovered by Elwood and his wife. Police were called and Schaer fled the house on foot.
Shaer wasn’t through that night, however, and came back at 11:46 PM. Elwood attempted to distract and then detain Schaer, and allegedly tackled him and held him down in the street as his wife called police. Schaer struggled and then continued to fight as two officers intervened and attempted to make the arrest. Officers then deployed a taser on Schaer which ended the altercation.
Schaer – a convicted felon due to a guilty plea to marijuana possession with intent to deliver – was charged with 3rd degree burglary and interference with official acts. He later pled guilty to that charge and was given probation, a suspended fine, a suspended prison sentence and was ordered to submit a DNA sample as well as pay $1,644.66 in restitution and court costs.
However, records show Schaer never made a payment on that balance, and in August, was accused by Cerro Gordo prosecutors of violating his probation. He is due in court on September 28 for a probation revocation hearing in which he could face all or part of the punishment which was suspended in his case.
