Local man escapes attempted rape charge

MASON CITY – Following negotiated guilty plea agreements to lesser charges, an assault with intent to commit sexual abuse charge has been dismissed at a plea change hearing for 21-year-old Jordan Jerome Holmes.

Holmes was arrested by Mason City Police Officers for an incident that occurred on April 29th, 2012 in which he was charged with an aggravated misdemeanor count of assault with intent to commit sexual abuse, a misdemeanor count of false imprisonment, and a simple misdemeanor count of domestic abuse assault.

Holmes had pled not guilty with a trial was set for June 26th in Cerro Gordo County District Court. Court records show just 5 days before the scheduled trial a plea change hearing was set up for June 27th.

At the plea change hearing the simple misdemeanor domestic abuse assault was amended to assault and Holmes was given two days in jail with credit for time served. For the false imprisonment charge Holmes received a 180 suspended prison sentence, and one year of probation. Sentencing District Court Judge Rustin T. Davenport also handed down a $315 fine, $110.25 surcharge, and $270.50 in court costs and lawyer fees.

The most serious charge of assault with intent to commit sexual abuse was dismissed on application by Judge Davenport on June 28th, the day after sentencing on the lesser charges.

not defending jordan or his behavior, he is accountable for that- BUT i can ASSURE everyone of u IT WAS NOT A CHILD INVOLVED!!!!! it was his girlfriend… i dont know the details, but i know both parties involved… again, just commenting to let it be known a child wasnt involved….

This is bad but where does it say the attempt was on a child? I’m not finding that in this article.

Really hope the boy or girl he did this to isn’t old enough to seek revenge. Cause then we’ll see them prosecuted and probably found guilt cause that’s the way the system is.

I don’t know this guy or the story but I never ever better see him on here again. We need to compile a list of the Judges and their actions on criminal cases so that the general public can be informed when it comes time for reappointment.

Shocking, another sex predator let go with a “suspended sentence”… I’m sorry, but a suspended sentence is like waiting for him to get in trouble again, then they MIGHT deal with it properly, might. I mean, why do judges care if rapists or child molesters are in the community? Hope they don’t have kids or wives that some puke gets a hold of! Sexual predators should never be allowed another chance in society, EVER! The damage they do to victims and everyone surrounding them is always going to be there. I am truly saddened by what Mason City is subjected to due to lack of sentencing for criminals. I hope those of you living in communities where this goes on takes a stand and put new Judges income election time whom care about every persons safety!

The prosecutors in North Iowa also need to be held accountable. They are agreeing to the plea deals that do not hold criminals responsible.

If money is the reason we are not locking scum up, let it be known i will gladly pay a higher tax to pay for their extended stay in county jail or prison or for their execution. Does anyone remember michael fay? i believe it was 1994 or 1995 he was caned in singapore for theft and vandalism i vote for caning i would love to take a couple of shots at some of these kids in the news lately.

I don’t know if this happened in this case, but often the victim does not want the case to proceed or does not want to cooperate with the prosecution of the case. If that is what happened the prosecutor and judge did the best they could.
