Northern Iowa man faces felony OWI after third drunken-driving arrest

MAYNARD — A Northern Iowa man with two prior drunken-driving convictions is now headed toward a possible jury trial after deputies allegedly caught him behind the wheel intoxicated for a third time.

Carter Thomas Nolan, 25, of Maynard, is charged in Fayette County with operating while intoxicated, third or subsequent offense, a Class D felony.

The latest case began at approximately 8:18 p.m. on April 12, 2026, when the Fayette County Sheriff’s Office received a report of a suspicious vehicle in the 4000 block of North Avenue near Oelwein.

Deputies located the vehicle in the 13000 block of 40th Street near Stanley. Following an investigation, authorities determined that Nolan was allegedly intoxicated and placed him under arrest.

He was transported to the Fayette County Jail and held for his initial court appearance. The Iowa State Patrol assisted the sheriff’s office during the incident.

Court records show the April arrest was not Nolan’s first encounter with Iowa’s drunken-driving laws.

Nolan’s first OWI case stemmed from an Oct. 8, 2023, offense in Fayette County. He pleaded guilty to first-offense OWI on Nov. 29, 2023.

A judge imposed a 90-day jail sentence but suspended 88 days. Nolan received credit for two days already served, was placed on probation for one year and was fined $1,250. Court records said half of the fine could be waived upon proof that he completed required treatment and installed an ignition interlock device.

Nolan (pictured at top) later admitted violating probation in that case. He pleaded guilty to the probation violation on Jan. 27, 2025, and received a five-day jail sentence, with credit for time already served. The remainder of his probationary term continued.

His second drunken-driving case arose from a Sept. 8, 2024, offense in Black Hawk County.

Nolan pleaded guilty on Dec. 6, 2024, to second-offense OWI, an aggravated misdemeanor. He was sentenced to 180 days in jail, with 173 days suspended, and received credit for five days served.

The court also imposed a $1,875 fine and placed him on probation for one year.

The third case is now moving deeper into the court system.

Nolan entered a written plea of not guilty on June 29. Court records show he waived his right to a speedy trial.

A pretrial conference is scheduled for Sept. 14, 2026, at 10 a.m. A jury trial is set for Sept. 30 at 9:30 a.m.

At Nolan’s initial appearance, the court authorized his release on a $5,000 unsecured appearance bond.

The case remains pending, and Nolan is presumed innocent of the current felony charge unless proven guilty in court.
