CLEAR LAKE – A Clear Lake man accused of incest has entered a guilty plea in the case.
Todd William Russ, age 45, was arrested and booked into the county jail on November 1 on a charge of incest brought by Clear Lake police. Allegedly, Russ had engaged in sexual contact with a person he is related to; court records didn’t elaborate. He was released 17 days later under the supervision of the Iowa Department of Corrections as he awaited court proceedings.
Under Iowa law, a person, except a child, who performs a sex act with another whom the person knows to be related to the person, either legitimately or illegitimately, as an ancestor, descendant, brother or sister of the whole or half blood, aunt, uncle, niece, or nephew, commits incest. Incest is a class “D” felony.
Russ and his public defender entered a guilty plea on January 20. He now awaits a March 23 sentencing hearing.

Perhaps documents didn’t elaborate because it was consensual sex between adults and shouldn’t be crime in the first place? I’d think if this was assault or child molestation, there would be other charges. It’s a waste of public resourced to prosecute adults for consensual sex.
Keith, I agree. Incest laws are based on very old genetic mutation occurrences where inbreeding caused a deterioration of the health of the offspring. While the ancient proscriptions were based in science, in today’s world of Liberty, contraception, and personal choice, these old laws should be abolished. While distasteful to many, it’s really none of government’s decision as to what consenting adults have sex, or reproduce for that matter. I think this should be challenged in court.

Wow so here we have a perfect example of government overreach based on archaic reasoning. 2 consenting adults related or not having sexual relations is none of the government’s business. We really need me in law school / college
