MASON CITY – A Mason City drunk driver has been jailed ahead of his trial for violating his pre-trial release.

A warrant was issued for the arrest of Gary Duane Foutch, age 56, on December 23 for violating the pre-trial release he was granted in his third drunk driving case. Fetch is now jailed as he awaits a March 10 jury trial. Foutch pleaded not guilty.

On the evening of December 3, a report was taken of a possible drunk driver, and law enforcement was alerted. A traffic stop was conducted by a Cerro Gordo deputy near 12th Street NE and and North Hampshire Avenue. At the scene, Foutch was behind the wheel and he refused to leave his car after an officer ordered him to do so. The situation became a traffic hazard and multiple officers were called to scene as traffic was backing up. Foutch soon left his vehicle and was placed under arrest. He was charged with second offense operating while intoxicated and interference with official acts.

Foutch is no stranger to drunk driving charges.

He was arrested in 2001 by Mason City police and pled guilty to second offense operating while intoxicated, which cost him nearly $5,000 in fines and court fees.

Fetch was arrested earlier in 1999, again by Mason City police, and pled guilty to first offense operating while intoxicated, which cost him $1,425 in fines and court fees.

Most recently, Foutch pled guilty to public intoxication on October 31, 2014, and was ordered to pay $214.50 in fines and fees.

He might as well admit it, he has a drinking problem as well as a mental problem.
