Charles City man faces more charges after 2nd police chase

FLOYD COUNTY – A Charles City police officer attempted to stop a motorcycle at 7th Avenue and D Street for a traffic violation at 8:31 pm on Wednesday, August 15th.

The motorcyclist fled and the motorcycle was later located at the dead end of 17th Avenue with the driver running away from the scene on foot.

The driver was located and apprehended a short time later by a Floyd County Sheriff’s Deputy at 15th Avenue and F Street.

Law enforcement has identified the driver as 19-year-old James Robert Hayes Vierkant of Charles City.

Vierkant was transported to the Floyd County Jail following the apprehension and charged with;
1 aggravated misdemeanor count of eluding
1 aggravated misdemeanor count of driving while barred
2 serious misdemeanor counts of driving while suspended
1 simple misdemeanor count of interference with official acts
1 count of failure to have SR-22 insurance
3 stop sign violations
1 count of reckless driving

The Charles City Police Department was assisted by the Floyd County Sheriff’s Department in the apprehension and investigation.

Vierkant is innocent until proven guilty.

According to court records, Floyd County Magistrate Marilyn J. Dettmer released Vierkant from jail the following day to the supervision of the Iowa Department of Corrections. Magistrate Dettermer also approved an application by Vierkant for court appointed council.

Vierkant is also awaiting trial in Floyd County on in three separate criminal cases.

In case one records show Vierkant was charged by Charles City police on Dec 26th, 2011 with a serious misdemeanor count of possession of a controlled substance. Vierkant has pled not guilty with a trial set for September 19th at 9 am.

In case two records show Vierkant was charged by Charles City police in March 2012 with one class D felony count of 2nd degree theft and one class D felony count of criminal mischief. Vierkant has pled not guilty with a combined trial set for September 19th at 9 am.

In case three records show Vierkant was charged by Charles City police in June 2012 with one agrevated misdemeanor count of assault with use or display of a weapon. Vierkant has pled not guilty with a combined trial set for September 19th at 9 am.

In addition to Viekant’s alleged criminal activities in Floyd County he also is facing charges in Chickasaw County related to a police chase in on July 12th, 2012. In that case Vierkant is charged with:
1 aggravated misdemeanor count of eluding
1 count of failure to maintain control of a motor vehicle
2 stop sign violations
1 speed violation of 11-15 mph over in a 55 zone

Record show Vierkant has pled guilty to one count of driving while suspended related to the incident. Vierkant’s next court appearance in that case is scheduled for August 21st at 9 am.

Unlike Floyd County, Viekant was required to post a $2,000 bond for the eluding police charge in Chickasaw County.

I already did a five year class c felony for 2nd degree criminal mischief with two 2 year sentences ran concurrent meaning you serve those as you serve the five year they cut it in half IOWA LAW I did 27 months plus two in County so 29 altogether

This is my son my hopes are that he can find Jesus Christ and get in to a bible teaching non denominational church and enjoy this short time we have on this earth I have spent my times in jail as a young adult. I am sober born again Christian and am living in grace I love my son and wish the best foe him I pray he will grow up and live a good life and learn from this.
