Mason City man pleads guilty in domestic abuse case

MASON CITY – A Mason City man has pled guilty in a domestic abuse case and received a deferred judgement.

Philip Christopher Biermann, age 29, was arrested on a charge of serious domestic abuse assault on December 22. Cerro Gordo deputies went to his house at 17162 Kingbird Avenue at about 2:03 AM that morning to investigate a report of a domestic assault. Upon arrival, a victim claimed a head injury, and Biermann was taken to jail.

After his release from jail, in an unsolicited statement, Biermann told NIT that, leading up to his alleged domestic assault crime, he “caught an affair in progress… The officers said they needed to take me no matter what because that is unfortunatly how the ‘system’ goes even if a person cries wolf.” He also claimed in a rambling statement that was delivered to NIT by a former employee of his that “I became a selfish man since the band ended, whom gave into money, success, alcohol and dabbled in some sexual addiction things with my wife that caused destruction.”

Just five days later, Biermann was arrested and jailed a second time, on a warrant for violating the court-imposed no-contact order between himself and his victim.  Sheriff Kevin Pals told NIT that Biermann had left a notebook at his house on December 27, leading to the arrest warrant.

On January 14, Biermann appeared in court.  A guilty plea was entered, but Biermann was given a deferred judgement in the domestic abuse assault charge.  He was given a year of probation and ordered to pay $417.00 in fines, court costs and other fees.   Court records were incomplete as to an outcome on the charge of violating the protective order on December 27.  The no-contact order was modified, and a deputy was seeking to serve the modified order to Biermann Thursday evening.
