In today’s “Ask Us” column in the Globe Gazette a question was asked, recently there was an article in the Globe about a trial set for a lawsuit involving an auto company. It said a jury trial is set to begin May 13, 2014. Is that a mistake by the Globe or are they actually waiting a year to take this case even though the suit was filed last year?
The Globe concludes that the blame falls on inadequate funding to pay clerks and judges. Nothing, I repeat nothing could be further from the truth. The only reason for these delays is the maneuverings of their defense lawyer. This is a common practice used by many lawyers to defuse public interest, to wait until public furor has died down and other horrible acts have grabbed the front pages of disgust.
I assure you there will be a trial, and the people they stole from intend to bring the full force of the law against them. The only thing that could possibly delay it further or make it go away is if the alleged thieves returned the fruits of their dastardly scheme….with interest; and we all know that’s never going to happen.
It is generally contented that these people broke La Frenz, cost them their dealership……what’s that worth?

I would like to answer a couple questions put forth here. It is true, I did have excellent attorney’s whenever I went into court. The late Mike Sweesy was a close personal friend of mine… and he was extremely proficient in his work It was Mike who told me the effectiveness of delaying the legal process until public interest waned. It works.
I was asked why I do not comment with a letter to the editor in the a Globe especially when my comment was derived from the Globe. First they probably wouldn’t print it, and secondly I want the most coverage… and this where it is at.
I am now told that the question originally asked pertained to a lawsuit filed against Pritchard Motors by their former bookkeeper who alleged fraud within the company. I have been told in regard to the alleged theft stemming from Mason City Ford, there will be no plea deal…..they are going to court, so they can only delay so much before it all comes out in the court room.
I posted a classified ad here on nit for my lawnmower and I got 3 calls first two days and sold it for what I was asking. SO I know people are here a lot. Love this site. Thanks Matt for all you do.
I’d like to know if there’s a decent auto dealership in town that’s honest and treats its customers with respect. I’m ready to buy a new vehicle but we pretty much have a monopoly owner selling cars in Mason City. He’s from Cedar Falls, so I don’t know much about him. I want to buy American. I’ve had bad experiences with Schukei. How about Clear Lake? Or Mike Molstead in Charles City? Any recommendations?
I realize that this is off topic a bit, but in response to just my opinion. I recently purchased a 2012 suv…and this is my experience. I wanted to buy local and the dealer community had the same vehicle I had shopped for in the area. The results…community was 6200 higher than a dealer in Minnesota. I asked them to come close to the price and they walked me out the door. This was the exact same vehicle with 3000 miles difference.
I would of liked to buy local but it is not worth 6200 buck to me to do that. The dealerships can sell a car for whatever they want to, but the way I look at it…some profit is better than no profit.

It is not unusual for a civil case to take two yeas before trial. Juvenile cases and criminal cases take precedent pursuant to the laws passed by the Iowa legislature. The problem is not the result of staff shortage in the clerk’s office nor is the result of any defense maneuvering although it could be the result of both the plaintiff’s counsel and defendant’s counsel waiting the results of production so they can properly prepare for trial. The delay is attributable to the low numbers of judges versus the high number of lawsuits.
I find it amusing that you blame defense attorneys when you own defense attorney was one of the best.
I did not realize this was a civil case. I thought criminal charges were filed.
If it is a criminal case, the prosecution must provide material documents to the defense and then vice versa. I understand this can take a while. The 90 day and 1 year speedy trial right of the defendant (not the prosecution or general public) can be waived. There can also be scheduling problems if more than 1 attorney is involved for the defense and whether the Attorney’s General’s Office has been called it. I am not surprised if the is a lot of “paperwork” that it takes this long.
The old dealer ship was not anymore shady the new one as far as I am concerned….Jim
