Iowa man who tried to cook meth at campsite sent to prison for 30 years

BOONE, IOWA – An Iowa man who tried to cook meth at a campsite has been sent to prison for 30 years.

On May 18, 2018, a Boone County District Court Judge sentenced Frank Marshall Kinyon, 47 years old of Boone, Iowa, to 30 years in prison with the Iowa Department of Corrections. The sentencing is a result of a guilty plea on April 23, 2018 in which he pled guilty to Manufacture or Possess with Intent to Manufacture Methamphetamine, Second or Subsequent Offense, as a Habitual Offender. On May 18, 2018, the court sentenced Frank Marshall Kinyon to 30 years in prison in which he must serve a mandatory minimum of 6 years.

According to the Complaint and Affidavits filed, this case started on August 11, 2017. On that date a Boone County Sheriff’s Deputy working with a Boone County Conservation Officer observed Frank Kinyon driving a car to a campsite in Boone County. The Deputy knew that he did not have a valid license to drive and made contact with Frank Kinyon. The Deputy arrested Kinyon for the violation and pursuant to departmental policies conducted an inventory of Frank Kinyon’s vehicle. Inside the vehicle the Deputy discovered a one-pot meth lab that could yield between 3.5 grams to 5 grams of methamphetamine. Frank Kinyon admitted that the lab was his and admitted to manufacturing methamphetamine. Deputies and Conservation Officers located other items consistent with the manufacturing of methamphetamine at the campsite.

The Boone County Sheriff’s Office filed charges on Frank Marshall Kinyon for Manufacturing a Controlled Substance. On April 23, 2018, Frank Kinyon pled guilty to Manufacture or Possess with Intent to Manufacture Methamphetamine, Second or Subsequent Offense, as an Habitual Offender in violation of Iowa Code section 124.401(1)(c)(6), 124.411 and 902.8. Sentencing was scheduled on May 18, 2018. On that date the State, represented by the Boone County Attorney’s Office recommended that Frank Kinyon go to prison for the maximum term. The Boone County Attorney’s Office noted Frank Kinyon’s long criminal history. A records check pursuant to Iowa Court’s On-Line shows that Frank Kinyon had conviction for Domestic Abuse Assault back in 1995; Felony Manufacture Methamphetamine conviction on August 26, 1998; Felony Controlled Substance conviction on January 3, 2011; and Felony Controlled Substance conviction on November 19, 2013. The court agreed with the Boone County Attorney’s Office and sentenced Frank Kinyon to 30 years in prison with the Iowa Department of Corrections in which the defendant must serve a mandatory minimum of 6 years.

First Assistant Boone County Attorney, Matt Speers, prosecuted the case on behalf of the State of Iowa for the prosecution. Frank Kinyon was defended by a local attorney. The Boone County Sheriff’s Office and Boone County Conservation investigated the case.
