All charges dismissed against Plymouth woman in connection to domestic incident

MASON CITY – Charges of domestic abuse assault and violation of a no-contact order against a Plymouth woman have been dismissed.

Ashley Joanne Dewaard, age 29, was arrested and charged with domestic abuse assault back on January 31 after an incident at her Plymouth home.  A no-contact order was put in place by a judge, mandating that Dewaard have no contact whatsoever with the alleged male victim.

On the evening of February 29, Mason City police were alerted that Dewaard “was eating with the protected party of a protective order at a Mason City restaurant.”  Police went to Whiskey Creek, 1519 4th Street SW, “arrived, saw the two together, verified the no-contact order was still valid, and arrested Dewaard without incident.”  She was charged with violating the no-contact order.

Dewaard was set for a jury trial on May 24 on the domestic assault charge.

However, at a contempt of court hearing this week, all charges were dismissed against Dewaard after at least two attempts were made in recent weeks to have the no-contact order lifted.  On March 17, both charges Dewaard faced were dismissed, and the no-contact order was lifted.  Dewaard must pay $115.50 in court costs, records show.

Uh, no, boyfriend refused to testify.

Don’t worry. They’ll start the whole thing over again in a couple weeks or so.
