Charles City man’s trial on two counts of sexual abuse pushed back to March

CHARLES CITY – A Charles City man that was arrested in March of 2014  and charged with two counts of sexual abuse has had his trial delayed again.

Two charges of felony C sexual abuse in the third degree were brought against 49-year-old Kenford Simon on March 10, 2014. The alleged dates of the sexual assaults were listed as April 17, 2013 and May 1, 2013 against a teenage female.

On April 4, 2014, Simon’s attorney, former Floyd county prosector Jesse Marzen, filed a not guilty plea. A jury trial date was scheduled for January 27, 2015.  A no-contact order was placed by a judge between Simon and the un-named accuser.

However, the trial was delayed until March 30, 2015, after an amended witness list was submitted in court by Marzen.

Sexual abuse in the third degree is a class C felony in Iowa. The act is done by force or against the will of the other person, whether or not the other person is the person’s spouse or is cohabiting with the person. The charge is punishable by up to 10 years imprisonment and a potential fine up to $10,000.
