SIOUX CITY – A man who re-entered the United States illegally was sentenced on August 27, 2014, to 41 months’ imprisonment.
Leopoldo Gamma-Deleon, age 40, from Mexico, received the prison term after a May 14, 2014, guilty plea to one count of illegal re-entry as an aggravated felon.
At the guilty plea, Gamma-Deleon admitted he had re-entered the United States without permission after being removed from the country on July 20, 2012. On February 6, 2006, Gamma-Deleon a/k/a Roman Vasquez-Tomas was convicted of criminal possession of a forged instrument in the District Court of Dakota County, Nebraska. Gamma-Deleon came to the attention of Homeland Security Investigations (HSI) after he was arrested on February 16, 2014, in Woodbury County, Iowa for operating a motor vehicle while intoxicated 3rd offense.
Gamma-Deleon was sentenced in Sioux City by United States District Court Judge Mark W. Bennett. Gamma-Deleon was sentenced to 41 months’ imprisonment. He must also serve a 3-year term of supervised release. A special assessment of $100 was imposed. There is no parole in the federal system.
The case was prosecuted by Assistant United States Attorney Kevin C. Fletcher and investigated by HSI and the Enforcement and Removal Office of the Immigration and Customs Enforcement Bureau.
