Garner man pleads not guilty to felony theft in boat incident; faces other crimes

clear-lake-boatingCLEAR LAKE – A young man from Garner accused of felony theft and other crimes after an incident in July on Clear Lake has pled innocent and has a trial date set.

Joshua Lawrence Engstler, age 19, pled not guilty on August 7 to felony 2nd degree theft. Judge Annette Boehlje set a jury trial date for September 30, 2014. A pre-trial conference is scheduled for September 19. On charges of unlawful consuming of alcohol, reckless use of a watercraft, interference with official acts and boating under the influence, Engstler will face a January 7, 2015 trial.

At least four law enforcement agencies responded to a situation on Clear Lake on July 5, 2014 at about 8:41 PM involving Engstler. According to a report, Engstler was intoxicated, combative and had allegedly stolen a boat at or near 6490 South Shore Drive. Clear Lake police, Iowa DNR officers, the Iowa State Patrol and Cerro Gordo deputies managed to get Engstler under control.

In June, a North Iowa woman sought protection Hancock county district courts from Engstler after a domestic assault incident, and was granted a protective order.

On July 25, Engstler pled guilty to unlawful consumption of alcohol after a charge was brought by the Cerro Gordo County Sheriff’s Office after an incident on July 12. He was ordered to pay $195.00 in fines and court fees.

In addition, Engstler stands accused by Garner police with criminal mischief in the fifth degree – hate crime – related to a criminal trespassing incident on May 24th, 2014. He also faces a second trespassing charge, also brought by Garner police. He awaits a preliminary hearing on August 20.
