Forest City business owner gets probation and suspended prison sentence in felony drug case

Court records show 3 search warrants were executed on properties owned by Dale Eric White by the North Central Iowa Narcotics Task Force July 15th, 2011 including one at Borderline Pizza and Video at 1145 Hwy 69 North in Forest City.

On August 12th a Forest Police Officer made a traffic contact with Dale White resulting in an OWI charge and possession of a controlled substance charge.

On August 22nd Dale White was arrested after the Iowa Department of Criminal Investigations filed a formal criminal complaint related to an investigation preceding the search warrant executions. White was booked into the Winnebago County Jail on one Class D felony count of possession of marijuana with intent to deliver, one Class D felony count of possession of a taxable substance without affixing a drug tax stamp, and one simple misdemeanor charge of possession of drug paraphernalia.

White posted bond the following day and entered a not guilty plea through his lawyer on August 19th demanding a jury trial that had been set for December 7th.

The trial was continued before a plea change hearing on January 25th in which White pled guilty to the Class D felony charge of possession of marijuana with intent to deliver.

During a scheduled sentencing hearing on Tuesday, March 20th, presiding District Court Judge Colleen D. Weiland dismissed the Class D felony count of possession of a taxable substance without affixing a drug tax stamp, one simple misdemeanor charge of possession of drug paraphernalia, and the possession of a controlled substance charge in the OWI case.

Judge Weiland then sentenced Dale White to a 5 year suspended prison sentence, 4 years of probation with the Iowa Department of Corrections, and suspended White’s license to operate a motor vehicle for 180 days. Judge Weiland also suspended all criminal fines and law enforcement surcharges in the drug case.

In the OWI case Judge Weiland sentenced White to serve 5 days in jail, pay a $1250 dollar fine, $437.50 surcharge, $10 DARE surcharge. Judge Weiland left a provision to suspended $500 of the fine if White produced a temporary work permit and SA evaluation with-in 14 days.

SUBJECT IS INNOCENT UNTIL PROVEN GUILTY.

The title of the article makes it look more serious and interesting than it actually is. Marijuana? Who gives a crap about that? Big deal. Now if someone gets caught with like 50 lbs of coke or meth and guns and 100s of thousands of dollars in cash or something, that’s worth reading.

Did you ever think not everybody is a drug (e.g. marijuana)user or in this case dealer? Did you notice it is a FELONY? I think it is news if a business man is a convicted drug dealer.

Don’t care what he does in his personal life his food is amazing!!!!!!

No wonder Taco Jerry’s taste so good 😉
