MASON CITY – A Clear Lake man avoided a 10-year prison term this week when he was sentenced on felony burglary and domestic assault charges.
Benjamin J. Frederick, age 32 of Clear Lake, was arrested last week by Clear Lake police and charged with felony C burglary, domestic assault and violating a no-contact order. The incident allegedly took place on December 18th at 6:30 AM in Clear Lake. He was later charged with assault while participating in felony, a D felony.
After Frederick pled guilty on March 11 to felony C second degree burglary and domestic assault causing injury, Judge Dedra Schroeder on Tuesday, April 29, sentenced him to a ten year suspended prison sentence, a suspended $1,000 fine, three years of probation and two days in jail. The charge of assault while participating in felony was thrown out as part of the plea deal. Frederick was assessed $5,920.00 in court costs and fees.
Frederick is still facing charges of felony second degree theft and fourth degree theft brought by the Clear Lake Police Department. He is represented in that case by Colin C. Murphy. He awaits a May 2 pre-trial conference and a May 13 jury trial.
