Mason City man faces 7th domestic assault charge following Sunday morning arrest

MASON CITY – At 3:59 a.m. Sunday morning Mason City police responded to a report of a domestic argument at 933 Jackson Ave North in Mason City. As a result of an investigation by police on scene 32-year-old Joshua Michael Homan charged with a class D felony count of 3rd or subsequent domestic abuse assault and transported to the Cerro Gordo County Jail.

Court records show Homan has been convicted six times in the past twelve years of domestic assaults, avoiding prison time through the court system with a series of plea bargains and amended charges.

Iowa has passed special legislating in which a defendant convicted of a 3rd offense domestic must serve no less than one year and up to five years in prison. With six convictions Homan has never pled guilty to a third offense, as plea bargains have allowed him to get the charges amended to multiple 2nd offenses to avoid the special provisions under a 3rd offense conviction.

Tracking the online records of his arrest the following was found:

Homan was arrested in August 1999 in Chickasaw Count on one count of simple domestic abuse assault. In December of 1999 he was acquitted of the charge.

Homan was again arrest in October 1999 by Mason City police on one count of serious domestic abuse assault. In January 2000 he was found guilty and sentenced to 3 days in jail.

Homan was again arrested in March of 2000 by Mason City police on one count of 2nd offense domestic assault. In May of 2000 he pled guilty to an amended charge of serious domestic abuse assault and received a 120 day jail sentence with 96 days suspended and one year probation.

Homan was again arrested in May of 2002 by Mason City police on one count of 2nd offense domestic assault. In August of 2002 he was found guilty of 2nd offense domestic abuse assault and received 2 days in jail, a 2 year suspended prison sentence, and 2 years of probation.

Homan was again arrested in June 2004 in Bremer County on one count of felony 3rd offense domestic abuse assault and one count of serious domestic abuse assault. In October 2004 he pled guilty to an amended charge of 2nd offense domestic abuse assault and the serious domestic abuse assault charge was dismissed. As a result he was sentenced to a residential treatment facility and again received a 2 year suspended prison sentence.

Homan was again arrested in June of 2007 by Mason City police on one count of serious domestic abuse assault and one count of obstruction of emergency communications. In June of 2008 he entered a negotiated voluntary plea of guilty to 2nd offense domestic abuse assault and the obstruction of emergency communications was dismissed by the courts. As a result he was sentenced to I year in jail with all but 90 days suspended and 2 years of probation.

Homan was again arrested in June 2010 by Mason City police on one class D felony count of 3rd or subsequent offense domestic abuse assault. In October 2010 he entered a negotiated voluntary plea of guilty to 2nd offense domestic abuse assault. As a result he was sentenced to complete residential treatment at Beje Clark, a 2 year suspended prison sentence, and 2 years of probation. In April 2011 he was found guilty of a probation violation after failing a drug test while at Beje Clark. As a result of the probation violation the 2 year prison sentence was imposed. Court records show he arrived in the custody of the Iowa Department of Corrections on April 27th but was released from prison by July 7th.

Homan has since been released from the Cerro Gordo County Jail pending further court proceedings and a no contact protective order has been issued.
