REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on May 7, 2024. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Adams, Symonds, Latham. Absent: Lee.

Adopt Agenda: Motion, Masson; 2nd, Latham that the agenda be adopted: AYES: All (Motion carried.)

The Mayor proclaimed May, 2024 as “Historic Preservation Month” and May 14, 2024 as “Apraxia Awareness Day”.

Prior to adopting the Consent Agenda Item #13 and #19 were removed to be acted upon separately.

Consent Agenda: Regular Minutes of April 16, 2024; Claims dated April 18, 25 and May 2, 2024 in the amount of $3,616,597.88; Hy-Vee Drug Store – Class B Wine, C Beer, E Liquor; Hampton Inn – Class C Retail Alcohol; Happy Donkey – Class C Liquor, Outdoor Service; Vallarta’s Mex Grill – Class C Liquor; Main Street Mason City of Mason City – Special Class C Retail Alcohol 9 N Federal Avenue (Federal Avenue Pedestrian Plaza – June 7, 14, 21, 28; July 12, 19, 26; August 2, 9 and 16, 2024); North Iowa Band Festival – Special Class C Retail Alcohol 5 day License (Central Park, Federal Avenue Pedestrian Plaza and Parts of North Federal Avenue and parts of East/West State Street – May 23-27, 2024); Appoint Miranda Lynn Reynolds to Housing Authority Board (TFV Stacy Munson) and Darshini Jayawardena Library Board (TFV Shelly Schmit); Reappoint Kevin Easley to Housing Advisory & Appeals and Paul Matthes and Arian Schuessler to Zoning Board of Adjustment; Resolution No. 24-97, levying assessments for charges on certain properties and the certification of same to the County Treasurer for collection with property taxes withing the City of Mason City, Iowa; Resolution No. 24-98, authorizing the temporary closing of public ways for North Iowa Band Festival; Resolution No. 24-99, approving the lease of a motorcycle for the Police Department at a cost of $1.00 and authorizing the execution of a Lease Agreement from Harley Davidson, Inc. of Mason City, Iowa; Resolution No. 24-100, setting a date of hearing on amending the current fiscal year budget ending June 30, 2024 Budget (Amendment #3) for the City of Mason City, Iowa; Resolution No. 24-101, approving the purchase of a Front End-Loader from Ziegler Cate of Mason City, Iowa for the Street Division; Resolution No. 24-102, approving the purchase of a Zero-Turn Mower from Floyd and Leonard of Mason City, Iowa for the Parks Department; Resolution No. 24-103, award of contract to Heartland Asphalt of Mason City, Iowa for repairs to the East Park and 4th Street NE Trail; Resolution No. 24-105 approving contract and bond for construction of the “2024 Street Panel & Curb Replacement Program Project No. 24-1005”; Resolution No. 24-106, accepting work and ordering payment for construction of the “Lakeview Preserve Dredging Project No. 21-1012”; Resolution No. 24-107, award of contract to WHKS & Co. of Mason City, Iowa for professional services related to the 4th Street NE Retaining Wall Feasibility Study; Resolution No. 24-108, approving and authorizing adoption of changes to the boundaries of the Downtown Revitalization Loan (DoRL) area; Resolution No. 24-109, authorizing submission of an application for the Iowa Thriving Communities Designation to the Iowa Economic Development Authority and the Iowa Finance Authority for scoring points for the Federal Housing Tax Credit and/or Workforce Housing Tax Credit Programs; and authorizing execution of related documents if approved; Resolution No. 24-112, authorizing submission of a Building Renovation/Life Safety (BuRLS) Grant application for Foxtrot Properties, LLC located at 122-124 North Federal Avenue and authorizing execution of grant agreement upon application approval; Resolution No. 24-113, authorizing submission of a Building Renovation/Life Safety (BuRLS) Grant application for Kinderhaus MMFD, LLC located at 213 1st Street SE and authorizing execution of grant agreement upon application approval; Resolution No. 24-114, support for an application through the Safe Streets and Roads for all (SS4A) Program from the Department of Transportation for improvements to the Highway 122/4th Street SW Corridor in the City of Mason City, Iowa, was presented. Motion, Masson; 2nd, Jaszewski that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

13. Purchase Park Department Trail Equipment: Motion, Adams; 2nd, Latham that Resolution No. 24-104, approving the purchase of a Debris Loader from Floyd and Leonard of Mason City, Iowa; a Dump Trailer from Cedar Valley Sales of Nashua, Iowa; and a Debris Blower from Van Wall Equipment of Mason City, Iowa for the Parks Department, be adopted. Questions followed regarding the equipment. AYES: All (Motion carried.)

19. DoRL Loan – Foxtrot Properties and Kinderhaus: Motion, Adams; 2nd, Jaszewski that Resolution No. 24-110 authorizing approval of a forgivable loan to Foxtrot Properties, LLC for the rehabilitation of 122-124 North Federal Avenue in conjunction with the Downtown Revitalization Loan Program and 24-111, authorizing approval of a forgivable loan to Kinderhaus MMFD, LLC for the rehabilitation of 213 1st Street Southeast in conjunction with the Downtown Revitalization Loan Program, be adopted. Appreciation was extended to the applicants and questions regarding how many applicants. AYES: All (Motion carried.)

State Transit Assistance Funds and Federal Funds: The Public Hearing was held as per published notice. Mayor Schickel asked for comments which were noted. There being no further comments the Public Hearing was declared closed. Motion, Latham; 2nd, Adams that Resolution No. 24-115, authorizing application for State Transit Assistance Funds and Federal Funds for non-urbanized areas for financial assistance and commitment of city funds for Mason City Transit System, be adopted. AYES: All (Motion carried.)

Division of Taxes – Stellar TIF Ordinance: Motion, Jaszewski; 2nd, Latham that Ordinance No. 24-7, providing for the division of taxes levied on taxable property in the Mason City Unified Urban Renewal area, pursuant to Section 403.19 of the Code of Iowa, be adopted. AYES: All (Motion carried.)

Change Zone – Z4 to Z6 Restricted Industry: Motion, Adams; 2nd, Jaszewski to waive Second Reading and move to Final. Comments followed. AYES: all (Motion carried.) Motion, Masson; 2nd, Latham that Ordinance No. 24-8, amending Title 12 of the City Code, it being the Zoning Ordinance of said city and changing the boundaries of certain districts therein zoned Z4 Multi-Use Zoning District to Z6-R Restricted Industry generally located in the 1500 block of South Federal Avenue, subject to the terms of the Conditional Rezoning Agreement, be adopted. AYES: All (Motion carried.) Motion, Adams; 2nd, Masson that Resolution No. 24-116, authorizing approval and execution of a Conditional Rezoning Agreement between the City, JARC Corporation and Joel D. Ernst regarding property located in parcels 07-16-276-005-00 & 07-16-276-016-00, be adopted. AYES: All (Motion carried.)

Sanitary Sewer Rate Plan: Motion, Adams; 2nd, Latham that the Ordinance amending the City Code by repealing Title 6, Chapter 2: “Sanitary Sewers”, Article A: “Sewer Rates” Section 3: “Schedule of Rates”, Subsection A and B and adopting a new Subsection A and B in lieu thereof be received and placed on file for First Consideration. Discussion followed regarding the rates and the process. AYES: All (Motion carried.)

Storm Sewer Rate Plan: Motion, Latham; 2nd, Jaszewski that the Ordinance, amending the City Code by amending Title 6 “Municipal Utilities, Chapter 3 “Storm Sewer”, Section 1 “Definitions” and by repealing Article A. “Stormwater Utility Policy” and adopting a new Article A in lieu thereof be received and placed on file for First Consideration. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:36 p.m.
