Iowa domestic abuser sent to prison after he’s caught using meth

CORALVILLE, IOWA – An Iowa domestic abuser blew his shot at probation by taking illegal drugs and a judge finally sent him to prison for his crimes.

Daniel Ziegler, 50, of Fort Dodge, was previously convicted of Domestic Abuse Assault by Impeding Normal Breathing or Circulation of Blood without causing Injury, an aggravated misdemeanor. For that crime, Ziegler was sentenced to 2 years in prison, with all but 2 days of the prison sentence suspended. He was placed on supervised probation to the Department of Correctional Services and ordered to complete Batterer’s Education Programing and to pay various financial obligations.

On behalf of the Department of Correctional Services, the Webster County Attorney’s Office requested that Ziegler’s probation be revoked for violating the terms and conditions of his probation. At a hearing on December 7, 2015, the Honorable Angela L. Doyle, District Associate Judge, found that Ziegler violated the terms of his probation by using methamphetamine and marijuana, failing to follow through with required substance abuse treatment, and by failing to maintain contact with his probation officer.

On January 19, 2016, a dispositional hearing was held where the State argued that the Defendant’s probation be revoked and that the original sentence be imposed. Ziegler requested that his probation continue to allow him to complete inpatient substance abuse treatment. Following the oral arguments of the parties, Judge Doyle revoked Ziegler’s probation and ordered him to serve the original sentence. Ziegler was remanded to the custody of the Webster County Sheriff for transport to the Iowa Medical and Classification Center at Oakdale, Iowa, to serve his 2 year prison sentence.

This probation revocation matter was prosecuted by Hans Becker, Assistant Webster County Attorney. Ziegler was represented by Jason Carlstrom. Although the nature of the original domestic assault charges against Ziegler were serious, one of the goals of sentencing as set out in the Iowa Code is rehabilitation, the Webster county attorney’s office says.

“In this case, the State believed that substance abuse was an underlying factor to the commission of the original offense, and that treatment would assist Ziegler in becoming a productive and law-abiding member of our community,” the Webster county attorney’s office said in a statement. “Unfortunately, efforts at rehabilitation were not successful, and incarceration became necessary.”
