UPDATED: Teen and man both arrested for drunk driving after being found passed out in car with baby

MASON CITY – Police were able to get two intoxicated individuals off the streets and rescue a baby from their custody early Wednesday.

According to a Mason City police spokesman, on July 29, 2015, at 2:59 am, witnesses reported a male and female, unresponsive, in a parked vehicle in the Walmart lot, 4151 4th Street SW. Witnesses reported there was a baby in the car. Officers arrived and found the vehicle and three occupants as described by witnesses. Officers removed the baby and were unable to awaken the two adult passengers. MCFD medics responded and were eventually able to awaken the two adults and evaluate them. The driver, 17-year-old Rashell Davis of Mason City, was arrested for operating while intoxicated. Davis was processed at the jail and released to a parent.

The baby was unharmed, police said, but they did not elaborate on where it was taken. “DHS was notified, a police spokesman said. “I assume the baby was released to a sober adult with no prior at-risk histories but I cannot confirm who the baby was released to at this time.”

Later, that same morning, at 5:56 am, a witness reported a car parked on the road in the 000 block of 16th Street NE, running, with a male passed out inside the car. Officers investigated and recognized the driver as the prior passenger from the earlier incident. Officers awoke the subject and conducted field sobriety tests. The 24-year old driver, Darius Leopaul of Forest City was arrested for operating while intoxicated.

Leopaul was jailed and later released as he awaits a court date on August 14. A charge of carrying weapons while intoxicated was dropped against Leopaul last year in Kossuth county.
