Sheffield woman receives suspended sentence in child endangerment case

MASON CITY – A woman who was a passenger in a car with a drunk driver – along with three children – when the car crashed received a suspended jail sentence Monday.

Margaret Brown, age 30 of Sheffield, was sentenced today in Cerro Gordo County District Court to a 5-year suspended prison sentence along with 5 years of probation. She had been awaiting sentencing since being found guilty of felony D child endangerment resulting in bodily injury on October 25, 2013.

On April 27th, 2013, Robin Jenks of Sheffield was driving a 1994 Honda Accord south bound on Partridge Ave. when she lost control of the vehicle.  Jenks, Brown, Kyla Williams age 8, Jaylan Brown age 5, and Tristan Jenks age 14 months all of Sheffield were all passengers in the vehicle at the time of the accident. All occupants sustained injuries as a result of the accident and were transported to Mercy Medical Center North Iowa.

Jenks was sentenced to prison and is being held at the Iowa Medical & Classification Center at this time.

I completely understand why this woman was charged. She placed her children in jeopardy by allowing them in a vehicle with an impaired driver. When it comes to children, I’m erring on the side of caution. It’s a good deterrent message to send to the rest of the population. Now with that said, police need to apply this law evenly. That means if daddy had some drinks at Applebees with his family, or while eating at Chop had a glass or two of wine…then daddy needs to get pulled over. What makes this questionable is how law enforcement selectively applies it to seemingly poor, disenfranchised people.

I guess I don’t understand this one. If she was not driving how can she be guilty. She had no way of knowing the driver was legally drunk. It seems like another case of just throwing charges at her to see what sticks.
