Attempted sexual abuse not enough for jail time for Mason City man

MASON CITY – A Mason City man already on probation was given more probation after a jury convicted him of assaulting a woman with the intent to sexually abuse her. He will also serve no jail time for the attempted sexual abuse of the victim.

According to a police incident report Mason City police were called to the emergency department at Mercy Medical Center – North Iowa shortly after 5:30am on February 23rd, 2012 to take a sexual assault report.

Mason City police later arrested 40-year-old Jose Adrian Martinez Casillas on a warrant issued by Magistrate Ronald J. Wagenaar and charged him with one class C felony count of 3rd Degree Sexual Abuse. Casillas was released the same day after North Iowa Bonding posted a $10,000 surety bond in his name.

Casillas received a jury trial in Cerro Gordo County District Court in December. The jury found Casillas guilty of a lesser offense of 709.11 Assault with Intent to Commit Sexual Abuse. Following the conviction for the attempted sexual abuse District Court Judge DeDra L. Schroeder allowed Casillas to remain free on bail pending his sentencing hearing on February 1st.

While awaiting sentencing Casillas’ lawyer Richard Piscopo JR motioned the court to overturn the jury’s verdict and grant his client an acquittal. Court records show Judge Scroeder denied the request on January 29th.

At Casillas’ sentencing hearing on Friday, February 1st, presiding District Court Judge DeDra L. Schroeder suspended a 6 month jail sentence against Casillas. Instead Judge Schroeder sentenced Casillas to 3 years of probation with the Iowa Department of Corrections. Court records show he already ordered to serve 2 years of probation in November 2012 following convictions for 2 separate OWI’s and unlawful possession of prescription drugs.

In addition to extending Casillas’ probation by one year Judge Schroeder ordered him to pay the minimum fine of $625.00 for the offense.

Under Iowa sex offense laws Jose Adrian Martinez Casillas is required to register as a sex offender for a period of 10 years. At this time the Iowa Sex Offender Registry does not show him as registering. A protective no contact order was extended for a period of 5 years.
