Mason City woman gets 6 felony charges dropped in plea bargain

MASON CITY – Although Shannon Renae Lybarger, age 25, of Mason City has kept local law enforcement busy with at least six arrests that included 9 felony charges and 2 misdemeanor since August 12th, 2011, she will not be sent to prison.

Lybarger was charged with one class D felony count of 2nd degree possession of stolen property in October 2011 by Mason City Police.

Later in October 2011 Lybarger was charged by Mason City Police with two class D felony counts of forgery, three class d felony counts of unauthorized use of a credit card, and one class B felony count of ongoing criminal conduct.

While on pre-trial release on those charges Lybarger was again arrested by Mason City Police in May2012 and charged with one class d felony count of 3rd degree burglary and one class d felony count of forgery.

Court records show Lybarger entered voluntary negated guilty pleas to three of the nine felony charges on July 9th before being released from the Cerro Gordo County jail following the plea change hearing.

Lybarger pled guilty to one class D felony count of 2nd degree possession of stolen property, one class D felony counts of forgery, and one class d felony count of 3rd degree burglary.

At a scheduled sentencing hearing on Monday, August 27th, presiding District Court Judge Colleen D. Weiland sentenced Lybarger to three separate five year suspended prison sentences. Instead of prison Weiland ordered Lybarger to Beje Clarks residential facility for 180 days or until maximum benefits are achieved. Judge Weiland ordered Lybarger to pay $2,067 in public defender costs, court costs, and surcharges. Lybarger must also pay $500 restitution in the possession of stolen property case.

Judge Weiland also suspended three $750 civil penalties in the convictions. Judge Weiland then dismissed on application two class D felony counts of forgery, three class d felony counts of unauthorized use of a credit card, and one class B felony count of ongoing criminal conduct.

In addition three contempt of court charges were dismissed by Judge Weiland related to Lybarger’s violations of pre-trial release while awaiting depositions in her criminal cases.

SUBJECT IS INNOCENT UNTIL PROVEN GUILTY.

Impeach her …if she gets enough complaints ..the congress of Iowa will look into her past ..and with her being investigated she will start to listen to the people …about letting all these criminals go …it needs to be sent to a higher level however it goes ..write to your congress man …if he gets enough people complaining he will have to look into the matter …its his duty to us ….he’s there because of votes…. just a thought!!

Regardless of what pleas or reasonings are put before the judge by the idiot you have for a county attorney, the judge still has final say. This woman should be removed immediately. She is a waste of space and the tax payers money. Mason City is in real need of a political make over.

JUDGE WEILAND SHOULD HAVE NEVER BEEN GIVEN HER POSITION. EVERY TIME A CRIMINAL GETS OFF THEIR CHARGES SHES BEHIIND IT.

Time to get that carry permit and put these people away when the crime happens. I have put it off because I just hated to think I had to carry my sidearm in my hometown. I guess now is the time.

MCPD doesnt have to do much more than catch the usual suspects and put pressure on them for info let them out for a bit to snitch on some more people.

i personally know scumbags who steal and smoke meth but will call the cops or drops names on friends or family with no worries.

WOW were is the justice. Know wonder people do what they want in Mason City you get away with anything and everything. I know prisons are over populated but 6 felony and she walks just don’t get it.

Maybe it’s time to look into having this judge removed from the bench before she can do more damage!

I am not going to be an apologist for this judge, or any. However, we only see the results of cases, and not the facts and pleadings before the court.

In deciding cases, consideration is based upon the facts presented to the court, or lack thereof. When the defense decides to apply for leniency, or pleades down to lesser charges, they offer up reasons. The Department of Corrections also offers up an opinion on the appropriatness of the pleadings. All this is placed before the judge, who will then render their decision.

It’s quite easy to sit in this armchair and decide if a judge or prosecutor are doing their job based only on prima facie evidence.

Trust me my retention vote in 2014 will be not to retain Judge Weiland, it will not be done from my armchair.

Where did you go to school? Please tell me you were home schooled with writing like this.
