Inequity
There is an unbalance of values happening in this town and it’s as plain as the nose on your face. It centers on the Alex Kuhn ordinance that could be credited for closing Chop/Eleven. Kuhn admits he copied the ordinance from another community but does not go further as to whether or not it’s ever been validly tested in court. I think that opportunity might be closer then you can imagine.
While the issue at hand centers on drinking establishments it also said to include a myriad of descriptions that reach into housing area, and anywhere the police might be called. This brings up the all too important question of just who makes the determination as as to the final decision on whether or not the “police call” will be classified against or in favor of the landlord for a nuisance.
My studiy has so far introduced yet another important aspect to this new fledgling alleged law. (1) As of yet we really don’t know if it’s an actual law; that has yet to be determined. (2) A preliminary finding has uncovered that properties owned by certain individuals have a strong tendency to be able to evade the “nuisance” ruling for the same offence that other landlords are being punished for. Of course the local police are well aware as to who owns the property they are being called to and could be prejudiced, where in a class action suit against the city a district court judge might read the same evidence and see it in a much different light. Speaking of lawsuits involving this city, there seem to be a deluge of them since Bookmeyer took office resulting in hundreds of thousands of dollars being paid out. I think it might be a good idea that if the total monetary payout for the city exceeds $350,000.00 the top two city officials must hand in their resignations. That in itself could solve a lot of problems because they would be history already. Then if the payout reached $500,000.00 the entire council would have to resign, that would mean they too would be gone by the end of the year. I am dwelling far too long of housing when in truth there are numerous infractions in the after hour bar business that are being overlooked; for instance many of you might not be aware of it but we have our very own “hook-ah bar” right in the center of town….but more on that later.

First I would think most everyone would know what constitutes a nuisance, except perhaps those that are creating the nuisance. Understand this entire thing has very little to do with what is or isn’t a nuisance.
This focuses on equality of the ordinance. If this ordinance has a shread of validity which still has to be proven, it is not being applied fairly in this city by the authorities who are enforcing it. That my friends is the true crux of the matter. It is against the law to make up a collection of words then use them to put someone out of business. Then on top of thst, look the other way when another violator fits the same description and is not charged.l
Amazing, Mr. Children actually made a salient point without any racial undertones or dog whistles. Gold star for the day!
Question for Mr. Children, as well as anyone who would like to respond, since the council’s ideas are not acceptable what are your ideas to combat “nuisance” properties and establishments?

I assume you are speaking to all the weed smoked outside of Lorado’s. I look forward to your opinion on that.
GOOD GOD ALL MIGHTY! Isn’t drug dealing, fighting all hours of the night, heavy traffic with loud cars in the middle of the night (waking working residents) enough to say NUISANCE?! Other RESIDENTS on the block who actually PAY TAXES (unlike those causing a problem that DON’T pay taxes) have rights too! DUUUUUUUUUUUUUUUUUUUH petey.smh. Pete Children is beginning to sound like a bafoon. Using NIT sight to air his grievences against GOOD citizens on the council who are trying to help our TAXPAYING WORKING citizens by ousting the PROBLEMS caused by NON WORKING NON TAXPAYING citizens.
They didn’t need the “kuhn ordinance” to close down 11. That ordinance covers every place that sells beer/liquor downtown. What is does give them the ability to do is close down ANY bar downtown they want no matter where trouble has started. Good luck bar owners and try to stay out of trouble.

I think that if there are nuisance calls to a residency over and over again, the owner of these properties need to be fined…..each time. Maybe the slumlords will not rent to drug dealers and welfare junkies if they have to pay fines repeatedly for the police calls to these homes.
Just heard that eleven was broken into. They sure know how to get a man when he’s down .

There is plenty around here that is as plain as the nose on your face. It boils down to right and wrong with every issue this town has. Let’s face it, the more well to do have no time for much except the usual gatherings and money options. Who can suck who harder and become someone in their own mind. If they could only reflect back on their own beginnings. Now if Kuhn as well as the rest of our so called leaders could copy OTHER community things instead, we may have a fun place around here.
Wrong! The problem with MC is you jealous whiny idiots that piss and moan when a council tries to clear out the drug dealers from God only knows where and when council tries to reprimand those that support the dealers and drunks. What company would want to set up in MC where there’s nothing but GED flunkies sitting on a bar stool crying in their beer.
@Anonymous-Actually, I am backing the council on this. Something must be done to clean up this town and maybe they will finally get the idea it won’t be tolerated. I would like to see them take additional steps to prevent this type of actions. I think the comment from Peter is because it was a Greek establishment that was closed.
Or standing outside the front door stone out of their minds. The next time they pass a joint around it might be to a federal agent.
