Two men apprehended in North Iowa area sentenced to prison for illegal entry

Two men who illegally re-entered the Untied States from Mexico and Guatemala were sentenced on August 29, 2011, to federal prison.

Samuel Castro-Justo, age 22, from Mexico, and Oscar Pelico-Vicente, age 28, from Guatemala received the prison terms after each pled guilty to one count of illegal re-entry.

Castro-Justo was previously removed from the United States on October 13, 2009. He was encountered by Homeland Security Investigations (HSI) in the Wright County, Iowa, jail on June 9, 2011, while he was incarcerated for operating a motor vehicle while intoxicated.

Pelico-Vicente was previously removed from the United States on July 13, 2006. He was encountered by HSI in the Buena Vista County, Iowa, jail on March 9, 2011, while he was incarcerated for forgery.

The men were sentenced in Sioux City by United States District Court Judge Mark W. Bennett. Castro-Justo was sentenced to 4 months’ imprisonment and Pelico-Vicente was sentenced to time served. They each must serve a 1-year term of supervised release after their prison terms. There is no parole in the federal system.

Castro-Justo is being held in the United States Marshal’s custody until he can be transported to a federal prison.

The cases were prosecuted by Assistant United States Attorney Kevin C. Fletcher and investigated by HSI.
