Mason City car vandal who was irate his ex was in bed with another man is back in jail

MASON CITY – A man who caused hundreds of dollars in damages to cars parked on the North End of town, was later convicted and lost his appeal is now back in jail on connection to this case.

Joshua Joe Jennings was found guilty by a jury in July of 2014 after being accused of third-degree criminal mischief. According to Mason City police, Jennings damaged vehicles in the 1400 block of North Jefferson Avenue on or around March 30 of 2014. Damage was estimated at approximately $620. Court records show that Jennings damaged, defaced, altered or destroyed Joseph Yezek’s vehicle, among others.

In the conviction, Judge Karen Salic sentenced Jennings to one year in jail with all but 14 days suspended. She also suspended a $625 fine and placed him on two years of probation. Jennings was ordered to pay $2,068.32 in restitution and court costs. That amount has increased to $2,768.32, and Jennings has only paid $90.00.

Jennings is now accused of violating his probation in this case, and a warrant for his arrest was issued by a judge on February 3. He was booked into the jail Tuesday afternoon and is held on $2,000 cash-only bond.  He’ll face a February 29 court date.

After his conviction, Jennings had appealed the jury’s decision. He contended “there is no direct evidence linking [him] to Yezek’s damaged vehicle.” He asserted the district court should have granted his motion for judgment of acquittal because “no one personally observed [him] damage Yezek’s vehicle,” and “the police investigation yielded no physical evidence inculpating [him],” and his sister testified he “was asleep at her house . . . when she woke up” the next morning.

The State countered with strong circumstantial evidence, and according to court records, the Iowa Court of Appeals found that a reasonable juror could have found the following facts in upholding Jennings’ conviction and sentence:

Jennings’ ex- girlfriend, Pauline, and her friends were playing pool at a bar when Jennings showed up “mad.” Pauline decided to leave but was stopped by Jennings. Eventually, she left with a friend. Jennings followed. He “yell[ed],” called Pauline names she did not “care to repeat,” and asked her why she did not “want to go with him.” He also confronted one of her friends. The police were called, and Jennings left, although Pauline heard his truck, with its “distinct exhaust . . . noise,” continue to drive by.

Meanwhile, Pauline’s new boyfriend, Joseph Yezek, got off work and drove to Pauline’s friend’s house in a black truck with license plate BXP 896. He and Pauline eventually returned to Pauline’s house. In the interim, Pauline received a spate of text messages from Jennings, all referring to Yezek and his truck: “You were gon[n]a jump in with the guy in t[h]e black truck” (11:07 p.m.); “Your acting dumb your makin me do this” (11:11 p.m.); “Bxp896” (11:13 p.m.); “C you are a whore lil black truck wont exist much longer” (2:51 a.m.).

Pauline and Yezek went to bed, only to “hear [Jennings] driving by” and “circling the block.” The following morning, Yezek discovered damage to his truck in the form of a cracked windshield and broken glass in the front door. Inside his truck were shards of glass and a cement landscaping block. Pauline knew Jennings had a similar brick in his yard. A police search of the yard uncovered a “disturbed” area.

A reasonable juror could have inferred that Jennings intentionally damaged Yezek’s vehicle. Although there was no eye witness to the crime, the police investigation did not conclusively implicate him, and Jennings’s sister afforded him an alibi, substantial circumstantial evidence supported the jury’s finding of guilt.

Jennings is now in the Cerro Gordo county jail, serving a two week sentence for this crime.

I don’t understand how he was arrested for the vandalism. Years ago my ex left a voicemail saying he would be breaking out my car Windows. When the window was broken the next morning I called the police & played them the voicemail. They told me unless I had an eye witness there could be no arrest. Hmm. And by the way this Pauline they are writing about is a real piece of work. There aren’t enough bad words to describe her.

How does this news company get away with telling EVERYBODY details from these “criminals” personal lives? I’m really very surprised you haven’t been sued for slander… One other thought, if your ” journalists” have nothing better to inform the public about than stories like this one, about a man who caused $625 worth of damage to vehicles and then to bring his name and his personal matters into the Publics eyes about his wife cheating on him ,,then they really need to rethink what qualifies as NEWS!

if you think all information is news, then that makes you pretty simple.

Most of these scum bags get free medical , food stamps, dont pay for their kids, don’t pay their fines and could care less about the good people in town. That’s why we call them losers.

Just keep him in jail. They never learn and he will certainly reoffend.

Get your facts right!

Guys like this never learn, look at those in our county jail. Most are multiple offenders. Pisses me off they get in trouble and then we have to pay for a public defender for these f**ken losers. Hell they know the judicial system better then the court appointed lawyers Its all a game they play..

Great observation Scottie. Many of us share your same concerns. And everyone (in government) points the finger at someone else. Its the fault of the county attorney, law enforcement, the courts,the sentencing guidelines…… etc. No one in the system is accountable is accountable for holding these dirt bags accountable and we pay the price.
