State investigators continue gather evidence in police shooting of man in BMW

CEDAR RAPIDS – Agents with the Iowa Department of Public Safety’s (DPS) Iowa Division of Criminal Investigation (DCI), in cooperation with the Cedar Rapids Police Department, continue to investigate the Officer Involved Shooting incident which occurred on March 29, 2015 in the alleyway in the 800 block between Center Point Road and Daniels Street N.E.

That evening, police observed a 2015 BMW M4 traveling the wrong way on a one-way street before crashing into a telephone pole. The driver, identified as Kyle Russell Orth, age 28, then drove in a “reckless manner” toward officers, who fired at him, and delivered non-life-threatening injuries. A female passenger suffered minor injuries due to the crash. Orth was treated at a local hospital and released.

Orth later told a local newspaper he didn’t expect to be shot for speeding.

The Cedar Rapids Police Department is asking for the public’s understanding of the logistics and necessary time that is required as this investigation moves forward. Both the Cedar Rapids Police Department and Iowa DCI are committed to a thorough and transparent investigation that is grounded in facts and evidence. The Iowa DCI must have adequate time to complete the investigation, organize the case and present it to the Linn County Attorney’s Office. No charges will be filed until the Linn County Attorney reviews the case and makes any decision.

The investigation involves an independent state agency (DCI) and the Linn County Attorney’s Office and will take some time to complete. The investigation and submission of a complete report to the Linn County Attorney’s Office could take in excess of 30 days. It will then be the Linn County Attorney who files any and all charges.

If there is any additional information that can be released to the public, the Cedar Rapids Police Department will do so with the consent of the Iowa DCI and Linn County Attorney’s Office.
