Corwith Man Convicted Of Federal Gun Crime

A man who possessed a firearm after having been convicted of five previous felonies, pled guilty on February 10, 2012, in federal court in Sioux City.

Randy Scott Smith, age 49, from Corwith, Iowa, was convicted of possessing a firearm having been convicted of a crime punishable by imprisonment for a term exceeding one year.

At Smith’s change of plea hearing, Smith admitted that he possessed a 9-millimeter pistol. Smith further admitted he was a convicted felon. State court records reveal Smith was convicted of operating while intoxicated on five different occasions between 1994 and 2005. According to information presented at the change of plea hearing by the United States, investigation revealed that on June 9, 2011, Smith had been drinking and became increasingly agitated through the day. Smith threatened to kill people with him his residence, then got the 9-millimeter pistol, and started waving the gun around. Smith also threatened to kill himself. The Hancock County Sheriff’s office transported him to Mercy Hospital in Mason City, Iowa.

Sentencing before United States District Court Judge Mark W. Bennett will be set after a presentence report is prepared. Smith remains in custody of the United States Marshal pending sentencing. Smith faces a possible maximum sentence of 10 years’ imprisonment, a $250,000 fine, a $100 special assessment, and 3 years of supervised release following any imprisonment.
