Mason City man finally serving drunk driving jail sentence 3 years after conviction

MASON CITY – Court records show a Mason City man now behind bars avoided his drunk driving jail term for over 3 years before cops caught him on a warrant.

Marcos Antonio Alberto, age 26, may have thought he was in the clear after his 2013 guilty plea to drunk driving. He was supposed to pay over $1,800 in fines and fees and serve a 2 day jail term. However, even as wages were garnished in order to secure payment, Alberto apparently never showed up for jail and an arrest warrant remained in effect since March of 2013.

Alberto’s taste of freedom came to a screeching halt just before 2 AM Thursday morning when, allegedly, he was drunk at the Kum & Go convenience store at 1920 South Federal Avenue in Mason City. Even though he was asked to leave, Alberto refused to kick rocks and police were called. Officers discovered the arrest warrant as they determined Alberto had consumed enough alcohol to become intoxicated.

Alberto was arrested on the charge of public intoxication – a charge he has faced several times in the past – and the arrest warrant. He was taken to jail and is now finally serving his 2 day sentence.
