Clear Lake man’s felony burglary trial pushed back to next year

MASON CITY – A Clear Lake man who has been in jail for weeks ever since we was arrested for breaking into a Mason City woman’s house has had his trial date pushed back to January.

Daniel Lee Franken, age 24 who used to live at his parent’s house Clear Lake until cops put him in jail, will stand trial on January 6 on a charge of felony second degree burglary. On September 25 at 2:17 AM, a violation of a no-contact order between Franken and his alleged victim of domestic abuse was reported in the 500 block of 21st Street SE, where his victim lives. Police told NIT that Franken reportedly entered the residence of the protected party. Once inside, Franken allegedly assaulted the protected party and obstructed attempts to contact police. A family member chased Franken from the residence and he apparently left in a vehicle. Franken was located a short time later at his parents’ house in Clear Lake and arrested.

Franken was charged with second degree burglary; violation of a no-contact order; obstruction of emergency communications; and 5th degree criminal mischief after police discovered that the victim’s vehicle had fresh damage apparently caused by Franken.

Franken later pled not guilty and was set for trial on November 18, but his lawyer, Joel Yunek requested a continuance, which was granted. His trial is now set for January 6, 2015. He won’t stand trial until May 26, 2015 on the criminal mischief charge.

Franken also faces a contempt hearing on December 17 in connection to a felony domestic assault case where he received a deferred judgement in August, just a few weeks before he allegedly went after the same victim.
