MASON CITY – A Meservey man escaped a felony drug dealing charge last week when he pleaded guilty to misdemeanor drug possession.
Records show that Nicholas Scott Henning was charged with possession of marijuana with intent to deliver in December by the Cerro Gordo County Sheriff’s Office. He originally pleaded not guilty. In March he accepted a deal from prosecutors to plead guilty to 1st offense possession of marijuana, a serious misdemeanor. Henning was sentenced to seven days in jail and ordered to pay $2,000 in court fees and fines.
Last year, Henning reported to the sheriff’s office that he accidentally shot himself in the leg. He was briefly hospitalized.

It looks like the legalization movement in Colorado is starting to rub off on local prosecutors. Thankfully this man avoided the more serious charges. Nice job judge and county attorney on allowing the reduced charges. You are doing the right thing by treating these as misdemeanors. I make this statement assuming the CA wasn’t trying to push for harder sentence.

When they eventually legalize marijuana what happens to the people who already are behind bars and some of them are in for life? Will they be let out or continue their sentence for something they legalized?
They stay in jail where they belong.
