REGULAR MEETING
OF THE CITY COUNCIL
The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on December 5, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Symonds, Adams, Latham, Lee. Absent: None.
Adopt Agenda: Motion, Masson; 2nd, Jaszewski that the agenda be adopted. AYES: All (Motion carried.)
Dr. Steven Shurtz with the Active Living
and Transportation Commission
provided an annual report.
Police Chief Brinkely presented the
Lifesaving Award to Sergeants Terrance
Prochaska and Joey Shearman and
Officers Josh Madole and Jim Redeker.
The Mayor recessed the meeting at 7:18

Prior to adopting the Consent Agenda Item #6, #12 and #13 were removed to be acted upon separately.
Regular and Worksession Minutes of November 21, 2023; Dated November 22 and 30, 2023, in the amount of $1,261,711.36; Dollar General – Class C Beer, Class B Wine; Village Court Family Restaurant – Special Class C Liquor; Kwik Star #1085 – Class B Retail Alcohol; The Sports Page – Class C Liquor, Outdoor Service; Addendum – Historic Park Inn – Class C Retail, Catering, Outdoor Service; Appoint/hire Katrina Cornick as a Firefighter/Paramedic, at a starting wage of $25.24/hour; Appoint/hire Matt Clark for hire as Police Officer at starting wage, $30.16/hour; Appoint/hire Rick Ott as Police Evidence Specialist at Grade G, Step 6, $24.24/hour; Appoint/Hire Rachel Glaza as Laboratory Technician at a starting wage of $27.81; Resolution No. 23-245, setting date of public hearing on amending the current Fiscal Year Ending June 30, 2024 Budget (Budget Amendment #2); Resolution No. 23-248, authorizing submission of a Certified Local Government (CLG) Grant application to the Iowa Economic Development Authority; affirming commitment for local match funds; and authorizing execution of grant agreement upon application approval, was presented. Motion, Jaszewski; 2nd, Latham that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)
6. October 2023 Finance Report: Motion, Symonds; 2nd, Jaszewski that the report be accepted. Discussion followed regarding the ambulance fund and the purchase of ambulances and whether the City was still on track and the status of the storm sewer funds. AYES: All (Motion carried.)
12. Award Contract – Bridge Inspections: Motion, Jaszewski; 2nd, Adams that Resolution No. 23-246, making award of contract to WHKS & Co. for professional services related to the 2024 Bridge Inspection, Rating and Maintenance Recommendations, be adopted. Discussion followed regarding what would happen should they find deficiencies. AYES: All (Motion carried.)
13. Order Hearing – Fire Department Remodel: Motion, Adams; 2nd, Symonds that Resolution No. 23-247, authorizing notice to bidders, fixing amount of bid security, and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “Mason City Fire Department – Dormitory Addition and Remodel”, be adopted. Discussion followed regarding the change in scope and the hope for a better bidding environment. AYES: All (Motion carried.)
Rezoning Newly Annexed Property to Z6-O, Open Industry: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion Jaszewski; 2nd, Symonds that the Ordinance amending the City Code it being the zoning ordinance of said city and changing the boundaries of certain districts therein unclassified to Z6-O, Open Industry Zoning District for land recently annexed to the City of Mason City, be received and placed on file for First Consideration. Clarification was made regarding the difference between Item #15 and #16. AYES: All (Motion carried.)
Amending Corporate City Limits: Motion, Masson; 2nd, Symonds that Ordinance No. 23-14, amending the city code, by repealing Title 1 “Administration”, Chapter 5 “Corporate Limits”, Section 1, “Corporate Limits”, in its entirety and adopting a new Section 1 in lieu thereof, to update the boundaries of the City of Mason City, in conjunction with annexation, be adopted. AYES: All (Motion carried.).

CONTRACTORS: NOTICE OF PUBLIC BID LETTING FOR THE MASON CITY FIRE DEPARTMENT DORMITORY ADDITION AND REMODEL, MASON CITY, IOWA AND THE TAKING OF BIDS THEREFORE.
NOTICE IS HEREBY GIVEN: BIDS FOR THE MASON CITY FIRE DEPARTMENT DORMITORY ADDITION AND REMODEL PROJECT WILL BE ACCEPTED FOR REVIEW AND CONSIDERATION.
Sealed bids for the Mason City Fire Department – Dormitory Addition and Remodel shall be received by 2:00 p.m. January 18, 2024, at City Hall, Deputy City Clerk’s Office, 10 First Street NW, Mason City, IA 50401, before 2:00 p.m., DST, according to the designated clock in the Deputy City Clerk’s Office. The Proposals will be publicly opened and read shortly after 2:00 p.m., January 18, 2024, at the City Hall, Deputy City Clerk’s Office, Mason City, Iowa. Neither the City nor its agents will assume liability for the inability of a bidder to submit a bid in a timely manner. Bidders bear full and complete responsibility for the timely submission of such bid. Bids received after the deadline will be rejected.
Consideration of bids and the award of contract may be made by the City Council of Mason City to the lowest responsive, responsible bidder determined on the basis of a combination of the base bid and selected alternates at the regular meeting on February 6, 2024, at 7:00 p.m. in the Mason City Room, Mason City Public Library, 225 2nd Street SE, Mason City, Iowa. The right is reserved to reject any and all bids, or any part thereof, and to waive informalities or irregularities and to enter into such Contract or Contracts as shall be deemed in the best interests of the City of Mason City.
At the regular meeting on February 6, 2024, a Public Hearing will also be held. At said hearing, the City Council will consider the proposed plans, specifications, form of contract and estimate of cost for said project, the same now being on file in the office of the Fire Chief, reference to which is made for a more detailed and complete description of the proposed improvements, and at said time and place the said Council will also receive and consider any comments/objections to said plans, specifications and form of contract or to the estimated cost of said improvements made by any interested party.
Scope of work includes, but is not limited to the following: The Work includes the remodeling of portions of the first floor and lower level of the existing Fire station building. A building addition will contain new dormitory facilities. Site improvements will be involved to support these changes.
A Pre-bid walk-through will be held Thursday December 21 at 10:00 a.m. at the Fire station for all Contractors interested in bidding the project. Interested parties shall meet at the reception lobby.
CONTRACTS:
Bids will be received and project constructed under a single prime contract. Bids must be on a lump sum basis. Work to commence on or about February 12, 2024, and be substantially complete on or before February 28, 2025.

Complete sets of bidding documents are available from Beeline + Blue, (515) 244-1611. Bidders may contact Beeline + Blue and visit their website (www.beelineplanroom.com) to order the Bid Documents. A $100.00 deposit or current MBI/ABC Plans Request Card, made payable to City of Mason City is required which will provide for a complete paper copy of the drawings and Project Manual specifications. Any shipping and handling costs are the responsibility of the bidder. Bidders shall have the option to make a special request to receive a CD copy of the Project Manual and Drawings in lieu of the paper copy. Plan deposits will be refunded upon the return of the documents, in good condition, to Beeline + Blue Reprographics within 14 days after the award of the project. Failure to comply will result in the forfeiture of the plan deposit.
BIDDING REQUIREMENTS:
Each Bid shall be submitted on the Bid Form provided with the Bidding Documents. No oral, facsimile or telephonic bids or modifications will be considered. Bids shall be addressed and delivered to the City Hall, Deputy City Clerk’s Office, 10 First Street NW, Mason City, IA 50401, —Attention Diana Black, City Clerk, in sealed envelopes marked with the Project Name and name and address of Bidder. All bids shall be sealed and plainly marked. Any alteration of the bid form may be cause for rejection of the bid. A signed copy of the Construction Progress Schedule and Resident Bidder Form are to be included with the bid.
Each Bid shall be accompanied by a Bid Security in the amount of five percent (5%) of the total bid submitted. Bid Security must be in the form set forth in the Instructions to Bidders and submitted in a separate sealed envelope clearly labeled Bid Security. Bid Security must be in one of the following forms: Certified Check, Cashier’s Check, Certified Share Draft or an approved Bond Form.
The successful Bidder will be required to furnish a Certificate of Insurance and Performance and Labor and Material Payment Bonds both in an amount equal to 100% of the Contract Price and in accordance with other requirements outlined in the Bid Documents.
Should the successful bidder fail or neglect to furnish satisfactory performance/payment bonds, refuse to enter into a Contract on the basis of the bid, or fail to meet the requirements of this Notice and the specifications regulating the award, the bidder’s security may be retained as liquidated damages. No bidder may withdraw its bid for a period of thirty (30) calendar days after the date and hour set for opening of bids.
IOWA STATE SALES TAX: This project is tax exempt. Do Not include Iowa State Sales Tax in any calculation of Bid totals. Contractors and Suppliers will be provided an Iowa sales tax exemption certificate for this project.
BASIS OF BIDS:
Bidders will be required to provide evidence of successful experience with projects of similar type and size. The City Council of Mason City reserves the right to conduct such investigations as it deems necessary to assist in the evaluation of any bid and to establish the responsibility and qualifications of the bidders, proposed subcontractors, and other organizations to perform the work in accordance with the contract documents to its satisfaction within the prescribed time. In addition, the City may require submission of AIA Document A305, Contractor Qualification Statement, at its discretion.
The Bidder shall include all requested Forms and attachments with their submission of the Bid Form; failure to comply may be cause for rejection.
By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the State of Iowa, and to Iowa domestic labor. A completed bidder’s resident status form must be submitted by all bidders with their bids.
All bids will be governed by applicable provisions in the Iowa Code and City Policies.
