WASHINGTON, D.C. – Supreme Court Justice Ketanji Brown Jackson has temporarily paused a lower court’s ruling that required the Trump administration to fully fund the Supplemental Nutrition Assistance Program (SNAP) for November during an ongoing government shutdown.
Acting in her capacity as the circuit justice for the 1st U.S. Circuit Court of Appeals, Justice Jackson issued an administrative stay on Friday, November 7, 2025. This action did not resolve the underlying legal issue but gave the appeals court more time to fully consider the Trump administration’s request for an indefinite stay on the lower court’s order.
A federal judge in Rhode Island, Jack McConnell, earlier ordered the administration to use a separate Agriculture Department contingency fund to cover the full cost of November SNAP benefits. The Trump administration appealed, arguing the judiciary was overstepping its bounds by directing how the executive branch should spend money.
A three-judge panel on the appeals court initially denied the administration’s emergency request for a stay.
Justice Jackson – appointed by Joe Biden against the wishes of the entire Republican Party – then temporarily paused the order, effectively siding with the Trump administration on a short-term basis and leading the U.S. Department of Agriculture (USDA) to issue guidance to states to only pay about 65% of the benefits and “undo” any full payments already made.
