    Now I feel bad for those people who lost power and heat, had water pipes break, and now face bills for thousands of dollars for the past week alone but hey, you chose how to be billed and you chose variable billing to keep your bills down instead of fixed-rate and paying a bit more per month. Don’t ask my taxes to cover your failures and the failures of your state.

    OF THE CITY COUNCIL

    The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on February 16, 2021. Due to COVID-19, the meeting was held as a virtual meeting via Zoom. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Thoma, Jaszewski, Symonds, Adams. Absent: Lee, Masson.

    Adopt Agenda: Motion, Jaszewski; 2nd, Thoma that the agenda be adopted. AYES: All (Motion carried.)

    The Mayor proclaimed Blair Smith and Carter Osmundson as “Mayor for the Day”.

    City Administrator Burnett presented his Monthly Activity Report. Council comments and questions followed the report.

    Prior to adopting the Consent Agenda Item #6, #10, #12 and #14 were removed to be acted upon separately.

    Consent Agenda: Regular Minutes of February 2, 2021; Claims dated February 4 and 11, 2021 in the amount of $1,186,598.90; Burkes Bar & Grill – Class C Liquor; Brix Wine and Whiskey – Class C Liquor; Mason City Multipurpose Arena – Class B Beer; North Side Liquor – Class B Wine, Class C Beer, Class E Liquor; Tobacco License – North Side Liquor; Reappoint Laura Little to the Historic Preservation Commission; Appoint/hire Rachel Van Hauen as Grant Administrator at pay grade H, step four at $23.11/hr.; Appoint/hire Kiera Quinn-Jordan to the position of Water Billing Cashier at pay grade F, Step one at $17.47/hr. Urban Revitalization Tax Abatement Program: Motion, Jaszewski; 2nd, Thoma that Resolution No. 21-34, granting preliminary approval for tax abatements allowed under the Mason City Urban Revitalization Tax Abatement Program for properties listed, be adopted. Clarification was made regarding how the program worked. AYES: All (Motion carried.)

    12. Catalyst Building Remediation Program Grant – 2 Artists, LLC: Motion, Adams; 2nd, Thoma that Resolution No. 21-35, authorizing submission of an application to the IEDA for funding from the Community Catalyst Building Remediation Program on behalf of 2 Artists, LLC for property located at 2 South Adams Avenue (former YWCA); affirming local matching funds (10 year 100% tax abatement); and authorizing execution of grant agreement upon application approval, be adopted. The grant was outlined and appreciation extended to 2 Artists, LLC. AYES: All (Motion carried.)

    14. Order Hearing – Proposed Property Tax Levy: Motion, Adams; 2nd, Jaszewski that Resolution No. 21-36, ordering a public hearing on the proposed property tax levy for the fiscal year July 1, 2021 through June 30, 2022, be adopted. An overview was provided. AYES: All (Motion carried.)

    16. Administrative Fee for Snow Removal Complaints: Motion, Jaszewski; 2nd, Symonds that the Ordinance, amending the City Code by repealing Title 5: Public Ways and Property; Chapter 1: Streets and Sidewalks; Article G: Sidewalks Kept Clean, Free from Snow and Ice; Section 5; Administration of costs and adopting a new Section 5 in lieu thereof, be received and placed on file for Second Consideration. AYES: All (Motion carried.)

    17. Establishing Grade Elevations for 2020 Paving: Motion, Adams; 2nd, Thoma that the Ordinance, establishing grade elevations on certain described streets in the City of Mason City, Iowa, for the “2020 Paving Program”,be received and placed on file for First Consideration. AYES: All (Motion carried.)

    12. Conveyance of Previously Vacated Alley in Central Heights: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Symonds; 2nd, Lee that Resolution No. 21-22, , conveying vacated public property to abutting property owners (North/South Alley) in Central Heights located in the block bounded by 19th Street SW, South Wilson Avenue, 18th Street SW and South Harding Avenue as set out in this Resolution, be adopted. AYES: All (Motion carried.)

    13. 2020 Paving Program: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. City Engineer Rahm entered into the record a petition against the paving signed by Dean C. Schaefer, owner of 3 individual parcels abutting the alley and amounting to a combined total of 12.57% of the project. There being no further comments the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Thoma that Resolution No. 21-23, with respect to the adoption of the Resolution of Necessity Proposed for the 2020 Paving Program, be adopted. Question followed regarding whether this was citizen lead. AYES: All (Motion carried.)

    13. 2020 Paving Continued Items B and C: Motion, Jaszewski; 2nd, Thoma that Resolution No. 21-24, directing preparation of detailed plans and specifications, form of contract and notice to bidders on the 2020 Paving Program, be adopted. AYES: All (Motion carried.) Motion, Masson; 2nd, Thoma that Resolution No. 21-25, ordering bids, approving plans, specifications and form of contract and notice to bidders, fixing amount of bid security, and ordering Clerk to post notice and fixing a date for receiving same, and for a public hearing on plans specifications, form of contract and estimate of costs, be adopted. AYES: All (Motion carried.)

    14.       According to the article, in the time from when the first vaccines were used, December 14, and Biden’s inauguration, January 20th, 15.6 million people were vaccinated in those 37 days. In the 27 days since the inauguration, 41 million more people have been vaccinated. It seems to me that the Trump team wasn’t doing much of a job getting those vaccinations out to the states. During the Trump term, about 400,000 were vaccinated per day. In the Biden term, about 1.4 million were vaccinated per day. If math is good, that means about a million more people per day are being vaccinated in the Biden term. That should tell you something about Trump’s preparedness. Facts matter.

    NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING ON PROPOSED PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF “RIVER CITY RENAISSANCE SKYWALK” PROJECT, IN AND FOR THE CITY OF MASON CITY, IOWA, AND THE TAKING OF BIDS FOR SAID IMPROVEMENTS

    Sealed proposals, subject to the conditions contained herein, will be received by the City Clerk of the City of Mason City, Iowa, at the City Clerk’s office in City Hall, 10 First Street NW, Mason City, Iowa, until 2:00 o’clock p.m. CDT on the 4th day of March, 2021 for:

    Construction of “River City Renaissance Skywalk”, as hereinafter described in general and as described in detail in the plans and specifications now on file in the office of the City Clerk, Mason City, Iowa.

    Bids received after the deadline for submission of bids as stated herein shall not be considered and shall be returned to the late bidder unopened.

    Proposals received will be opened, read aloud, tabulated, and referred to the City Council for consideration at a meeting beginning at 7:00 p.m. on the 16th day of March, 2021 in the Mason City Room, Mason City Public Library, 225 2nd Street SE, Mason City, Iowa. Bids will be acted upon at such time or at such later time as may then be fixed. Prior thereto, at said time specified above, a hearing will be held on the proposed plans, specifications, form of contract, and estimate of cost for said Improvements, and at said hearing any interested person may appear and file objections thereto.

    The extent of the work involved is the furnishing of labor and new materials for the construction of a skywalk including, but not limited to the following:

    The Project includes all labor, materials and equipment necessary for building a skywalk over US Highway 65, a letdown structure and sidewalk improvements just south of 2nd St. Southeast.

    The Proposal shall be made out on the form furnished by the City of Mason City and obtained from WHKS & Co., Engineers, Planners, and Surveyors, and must be accompanied in a sealed envelope by either: (1) a certified check, or a cashier’s check drawn on an Iowa bank, or a bank chartered under the laws of the United States, in an amount of 10% of bid amount; or (2) a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount of 10% of bid amount; or (3) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 10% of bid amount.

    The bid security shall be made payable to the City Clerk of the City of Mason City, Iowa.

    The bid security must not contain any conditions either in body or as an endorsement thereon. The bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into contract within ten (10) days after the award of contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and the maintenance of said work, if required, pursuant to the provisions of this notice and the other contract documents. The City will accept bid bond forms that meet the requirements of Iowa Code section 26.8.

    Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption.

    Bidders shall not be permitted to withdraw their bids for a period of forty-five (45) days after the same are opened.

    The City of Mason City, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for the award.

    Prospective bidders’ or contractor’s attention is specifically called to the Mason City Human Rights Commission Specifications which mandates that female and minority business enterprises shall be afforded the maximum opportunity to participate in the performance of this project. Prospective bidders’ or contractor’s attention is also directed to the fact that the Mason City Human Rights Commission will notify firms designated as Minority, Women, and/or Disadvantaged Business Enterprises, of this project and determine if they are interested in participating as subcontractors for this project. Prospective bidders or contractors shall then be notified by the Commission of those interested parties.

    The established DBE goal for this project is 0% of the total amount bid.

    By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa.

    In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.

    Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor’s resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.

    The Contractor shall commence work after the Notice to Proceed is issued and work shall be completed on or before October 29, 2021.

    Payment to the Contractor for said Project will be made in cash derived from the proceeds of the issuance of bonds as may be legally used for such purposes, governmental grants and/or from cash on hand. Any combination of the above methods of payment may be used at the discretion of the City.

    The Contractor will be paid each month ninetyfive (95) percent of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. Final payment will be made in accordance with Iowa Code chapters 26 and 573, as amended. No partial or final payment will be due until the Contractor has certified to the City that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications.

    The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent of the contract price, said bond to be issued by a responsible surety approved by the City and which shall guarantee a faithful performance of the Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of the improvements constructed for a period of two (2) years after completion and acceptance by the City.

    Plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners, and Surveyors, which plans and specifications and the proceedings of the City referring to and defining said proposed improvements are hereby made a part of the Notice by reference, and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifications are now on file with the City Clerk and at the offices of WHKS & Co., and may be examined by the bidders.

    Plans and specifications are available to download free of charge at http://www.questcdn.com. Plans and specifications for private use may also be obtained from WHKS & Co., Engineers, Planners, and Surveyors, 1412 6th Street SW, Mason City, IA 50402-1467, for a refundable deposit of $300.00. If the plans and specifications are not returned to WHKS & Co. within fourteen (14) days after the award of the project and in reusable condition, the deposit shall be forfeited. A limit of one set per bidder will be printed.

    The City does hereby reserve the right to reject any or all bids, to waive informalities, and to enter into such contract, or contracts, as it shall deem to be in the best interest of the City.

Trump implemented the travel ban on China, fast-tracked therapeutics, developed vaccines, and helped get vaccination numbers up to about a million doses a day. Biden comes along and all the big and important stuff has already been done. That’s what this stupid face mask idea is all about. Biden wants credit for doing something, even if that something is wasteful and unnecessary.

    The Democrats are racing to pass H.R. 1, the “For the People Act”. This bill has many egregious provisions including virtually eliminating any restrictions on vote-by-mail and significantly reducing the role states play in federal elections. This bill also represents a massive assault on our First Amendment right to free political speech. Please tell your representative that H.R. 1 is not the solution America needs for election security and protecting voter rights.

    Now I’m not Nostradamus, but I’m going to predict a surge of covid in Iowa in the coming weeks. I base that prediction on all the super bowl parties that are going to take place in homes and bars across the state.     Was there election fraud?
