Habitual drunk driver gets 30 days in jail, suspended prison term despite probation violation

MASON CITY – A Plymouth man caught last fall for drunk driving for the third time in his driving career is now serving time in the Cerro Gordo County Jail after accepting a plea deal Monday.

Kory John Ferden, age 26, is serving a 30 day jail sentence after pleading guilty to third offense operating while intoxicated. Judge Karen Salic threw out a five year prison term but imposed a $3,125 fine. Ferden must serve 40 hours of community service, spend five years on probation and serve 180 days in a residential facility, most likely Beje Clark. Ferden owes $4,408.75 in court fees, fines and costs.

The plea deal also involved a probation violation after a plea deal Ferden took in 2012 for multiple charges of possession of a controlled substance. Judge Salic threw out a five year prison sentence involved with that violation, as well.

There has to be some reasoning to all this blind justice that is being handed down, but what. Fines, he’s not paying no stinking fines. Maybe the next time he’s driving drunk he’ll run into someone from Salics family. Now would that be, drunken, justice.

Justice is supposed to be blind that is why all the statues of Themis (goddess of justice) have her with a blindfold.
The Iowa legislature proscribes the penalties for a crime. For OWI-3rd the penalty is a term not to exceed 5 years in prison and a fine of $3,125 0 $9,725. If the prison sentence is suspended the court must sentence a person for a least 30 days and up to 1 year in jail.
This person received a suspended prison sentence with probation and 30 days in jail.
As for paying fines — you don’t get blood out of a turnip not do you money out of a poor person.

Wow Nichole, are you related to one of the local judges…and thanks for the history lesson. There is really something wrong with the justice system, like everything else, it needs to be overhauled to bring it inline with the 21st century. By the way, if your to poor to pay the fines you get for breaking the law, you shouldn’t be a habitual drunk driver. I’m thinking that the system is just waiting until this habitual drunk driver kills somebody.

Well, let’s just thank God all he did was get caught driving a 3rd time and didn’t smoke any pot or he’d be on heroin by now according to righteous sheriff Kevin Pals. And he knows because he taught DARE and boinked married women.

Do you know what else hasn’t been proven? The ridiculous notion that pot makes you want to do hard drugs. About half the population have admitted getting high and we don’t see half doing hard illegal drugs. More unadulterated doggy doo doo. More self serving BS from a lying sack of doggy doo doo.
