OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on April 2, 2024. The meeting was called to order by the Mayor Bill Schickel and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Symonds, Latham, Lee, Adams. Absent: None.

Adopt Agenda: Motion, Latham; 2nd, Jaszewski that the agenda be adopted. AYES: All (Motion carried.)

The Mayor proclaimed April 6 – 12, 2024 as the “Week of the Young Child”.

Prior to adopting the Consent Agenda, Item #4, #7, #11 and #12 were removed to be acted upon separately.

Consent Agenda: Regular Minutes of March 19 and Special Minutes of March 26, 2024; Claims dated February 8 and 24, 2024 in the amount of $1,355,818.62; February Financial Report; Ppromote Gary Akins and Dustin Pillard to the position of Fire Captain at the rate of $40.04 per hour; Resolution No. 24-64, adopting a Master Schedule of Fees; Resolution No. 24-65, award contract to UKG/Kronos SaaShr, Inc., of Brachburg, NJ for automated timekeeping and human resources information system services; Resolution No. 24-66, approving property owner applications under the 2023 Downtown West Home Pilot Program and authorizing bidding of improvements, was presented. Motion, Jaszewski; 2nd, Symonds that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

4. Permits: Northside Liquor – Class E Retail and Mason City Multi Purpose Arena Special Class B Retail (License excludes North IA Bulls Hockey on North Side): Motion, Adams; 2nd, Latham that the recommendation be approved. Discussion followed regarding Northside Liquor, the previous applicant, status at IABD, etc. AYES: All (Motion carried.)

7. Purchase Dump Body and Plow: Motion, Jaszewski; 2nd, Symonds that Resolution No. 24-63, approving the purchase of one dump body and the removal and installation of new dump body from Highway Truck Equipment of Fort Dodge, Iowa for the Operation and Maintenace Division, be adopted. Update provided on the status of equipment. AYES: All (Motion carried.)

11. IEDA Community Catalyst Building Remediation 122-124 N Federal Avenue: Motion, Jaszewski; 2nd, Latham that Resolution No. 24-67, authorizing submission of a Final Application to the Iowa Economic Development Authority for funding from the Community Catalyst Building Remediation Program on behalf of Foxtrot Properties, LLC for property located at 122-124 North Federal Avenue, be adopted. Questions followed regarding the grant. AYES: All (Motion carried.)

12. Contract & Bond – Bike Park Bid Package 3: Motion, Masson; 2nd, Adams that Resolution No. 24-68, approving contract and bond for Mason City Bike Park Bid Package 3, be adopted. Comments followed regarding the project. AYES: All (Motion carried.)

Willow Creek Riverwalk Project: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. There being no comments, the Public Hearing was declared closed. Motion, Latham; 2nd, Jaszewski that Resolution No’s. 24-69 adopting plans, specifications, form of contract and estimated cost for the “Willow Creek Riverwalk Project” and 70, making award of contract to Henkel Construction Company of Mason City, Iowa for the “Willow Creek Riverwalk Project”, be adopted and the bid tabulation with the recommended bid from Henkel Construction Company of Mason City, Iowa in the amount of $3,738.500.00, accepted. Discussion followed regarding the number of bids, what Alternate 1 was, timeline, etc. AYES: All (Motion carried.)

2024 Pavement Marking Program: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. There being no comments, the Public Hearing was declared closed. Motion, Masson; 2nd, Jaszewski that Resolution No’s. 24-71 adopting plans, specifications, form of contract and estimated cost for the “2024 Pavement Marking Program Project No. 24-1003”, and 72, making award of contract to Henkel Construction Company of Mason City, Iowa for the “204 Pavement Marking Program Project No. 24-1003”, be adopted and the bid tabulation with the recommended bid from Weikert Contracting, Inc. of Cedar Falls, Iowa in the amount of $189,465.58.00. AYES: All (Motion carried.)

Planning & Design Loan – 43rd Street SW Lift Station and Loan Agreement: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. There being no comments, the Public Hearing was declared closed. Motion, Latham; 2nd, Symonds that Resolution No. 24-73, taking additional action with respect to a Sewer Revenue Loan and Disbursement Agreement and authorizing approving and securing the payment of a $180,000 Sewer Revenue Loan and Disbursement Agreement Anticipation Project Note (IFA Interim Loan and Disbursement Agreement), be adopted. AYES: All (Motion carried.)

Planning & Design Loan – Water Reclamation Nutrient Reduction Improvements: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. There being no comments, the Public Hearing was declared closed. Motion, Adams; 2nd, Symonds that Resolution No. 24-74, taking additional action with respect to a Sewer Revenue Loan and Disbursement Agreement and authorizing approving and securing the payment of a $1,525,000 Sewer Revenue Loan and Disbursement Agreement Anticipation Project Note (IFA Interim Loan and Disbursement Agreement), be adopted. AYES: All (Motion carried.)

Urban Renewal Plan Amendment No. 11: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. The Public Hearing was declared closed. Motion, Masson, 2nd, Latham that Resolution No. 24-75, approve Urban Renewal Plan Amendment No. 11 for the Mason City Unified Urban Renewal Area, be adopted. Discussion followed regarding how many jobs this would create. AYES: All (Motion carried.)

Stellar TIF Ordinance: Motion, Masson; 2nd, Jaszewski that the Ordinance b providing for the division of taxes levied on taxable property in the Mason City Unified Urban Renewal Area, pursuant to Section 403.19 of the Code of Iowa e received and placed on file for First Consideration. AYES: All (Motion carried.)

Development Agreement Stellar Industries: Motion, Adams; 2nd, Masson that Resolution No. 24-76, setting a date of meeting at which it is proposed to approve a Development Agreement with the Stellar Industries, Inc. including annual appropriation Tax Increment Payments, be adopted. Appreciation was extended to Stellar Industries. AYES: All (Motion carried.)

Amendment No. 6 Downtown Reinvestment Urban Renewal Area: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. There being no comments, the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Latham that Resolution No. 24-77, approve Urban Renewal Plan Amendment No. 6 for the Mason City Downtown Reinvestment Urban Renewal Area, be adopted. AYES: All (Motion carried.)

Order Hearing on Development Agreement– Dev Partners, LLC: Motion, Jaszewski; 2nd, Lee that Resolution No. 24-78, setting a date of meeting at which it is proposed to approve a development agreement with Dev Partners, LLC including annual appropriation Tax Increment Payments, be adopted. AYES: All (Motion carried.)

Order Hearing – Parking Lot Lease Agreement: Motion, Adams; 2nd, Latham that Resolution No. 24-79, fix a date of meeting at which it is proposed to take action for the authorization of a Parking Lot Lease Agreement with rent payments thereunder in an amount not to exceed $3,150,000, be adopted. Discussion followed regarding the need for parking in the downtown, secure indoor parking, the cost of leased parking, etc. AYES: All (Motion carried.)

Zoning Amendments: Motion, Symonds; 2nd, Masson that Ordinance No. 24-6, amending the City Code Title 12 “Zoning Regulations”: 12-1; 12-2; 12-5; 12-7; 12-13; 12-15; 12-16; 12-20 be adopted. AYES: All (Motion carried.)

Adopting 2024 North Iowa Corridor Joint Comprehensive Plan: Motion, Masson; 2nd, Latham that Resolution No. 24-80, adopting the 2024 North Iowa Corridor Joint Comprehensive Plan, be adopted. Comments followed regarding the cooperative agreement and jurisdiction. AYES: All (Motion carried.)

OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on April 16, 2024. The meeting was called to order by the Mayor Pro tem Paul Adams and on roll being called there were present, Paul Adams, Mayor Pro tem in the Chair, and the following Council Members: Jaszewski, Masson, Symonds, Latham, Lee. Absent: Mayor Schickel.

Adopt Agenda: Motion, Masson; 2nd Jaszewski that the agenda be adopted. AYES: All (Motion carried.)

The Mayor Pro tem proclaimed Friday, April 26, 2024 as “Arbor Day” and the month of May as “make It OK Month”.

Administrator Burnett presented the Monthly Activity Report. Council comment followed the report.

Prior to adopting the Consent Agenda, Item #10 and #13 were removed to be acted upon separately.

Consent Agenda: Regular Minutes of April 2, 2024; Claims dated February 4 and 11, 2024 in the amount of $1,381,346.50; Alcohol Licenses: Moos, Fleet Farm Fuel, Fleet Farm, Pasta Bella Restaurant, Legacy Golf Course, Mason City Motor Speedway; Acceptance of the March Financial Report; Promotion Tim Cahalan and Mitchell Smith to the position of Fire Lieutenant at the rate of $37.67 per hour; Resolution No. 24-81, approving the purchase of and installation of one heating air conditioning unit from North Central Mechanical of Mason City, Iowa for the Water Reclamation Office; Resolution No. 24-83, approving contract and bond for the “2024 Pavement Marking Program Project No. 24-1003”; Resolution No. 24-84, approving contract and bond for construction of the “Willow Creek Riverwalk Project”; Resolution No. 24-86, approving property owner applications under the 2023 Downtown West HOME Pilot Program and authorizing bidding of improvements, was presented. Motion, Latham; 2nd, Symonds that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

10. Purchase & Installation Collection Camera System: Motion, Jaszewski; 2nd, Symonds that Resolution No. 24-82 approving the purchase and installation of a Collection Camera System from Mid-Iowa Solid Waste Systems of Johnston, Iowa, be adopted. Questions regarding the camera system. AYES: All (Motion carried.)

13. Order Hearing & Letting – 22-1011 Murphy Park Trail & Bridge Project: Motion, Lee; 2nd, Latham that Resolution No. 24-85 authorizing notice to bidders, fixing amount of bid security, and ordering clerk to publish notice and fixing a date for receiving same and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of project “22-1011 Murphy Park Trail and Bridge Project”, be adopted. Discussion followed regarding project start and completion date. AYES: All (Motion carried.)

Change of Zone Z4 Multi-Use to Z6-R Restricted Industry: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections which were noted. Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized via Zoom. There being no further comments, the Public Hearing was declared closed. Motion, Masson; 2nd, Jaszewski that the Ordinance amending Title 12 of the City Code, it being the Zoning Ordinance of said city and changing the boundaries of certain districts therein zoned Z4 Multi-Use Zoning District to Z6-R Restricted Industry generally located in the 1500 block of South Federal Avenue subject to the terms of the Conditional Rezoning agreement be received and placed on file for First Consideration. Appreciation was extended to staff and discussion followed regarding waiving a reading. AYES: All (Motion carried.)

16. Adopting Annual Budget for FY Ending June 30, 2025: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections. There being none Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized via Zoom. There being no comments, the Public Hearing was declared closed. Motion, Latham; 2nd, Symonds that Resolution No. 24-87, adopting the annual budget for fiscal year ending June 30, 2025, be adopted. AYES: All (Motion carried.)

17. Mason City Bike Park Bid Package 2: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections. There being none. Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized via Zoom. There being no comments, the Public Hearing was declared closed. Motion, Jaszewski and seconded by Symonds that Resolution No’s. 24-88 adopting plans, specifications, form of contract and estimated cost for the “Mason City Bike Park Bid Package 2”, and 89, making award of contract to Rock Solid Trail Contracting of Copper Harbor, MI for the “Mason City Bike Park Bid Package 2”, be adopted and the bid tabulation with recommended bid from Rock Solid Trail Contracting of Copper Harbor, MI, Iowa in the amount of $2,288,934.18 be accepted. AYES: All (Motion carried.)

2024 Street Panel & Curb Replacement Program: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections. There being none the Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized via Zoom. There being no comments the public hearing was declared closed. Motion, Latham; 2nd, Masson that Resolution No’s. 24-90 adopting plans, specifications, form of contract and estimated cost for the “2024 Street Panel & Curb Replacement Program Project No. 24-1005”, and 91, making award of contract to Henkel Construction Company of Mason City, Iowa for the “2024 Street Panel & Curb Replacement Program Project No. 24-1005, be adopted and the bid tabulation accepted. AYES: All (Motion carried.)

#19 Dispose Property NW Corner of N Delaware Avenue & 1st Street NE: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections which were noted. Mayor Pro tem Adams asked if there were any written comments or objections with Burnett stating he has had conversations with quite a few folks, but there had been no written comments received and no one was seeking to be recognized on Zoom. There being no further comments the public hearing was declared closed. Motion, Jaszewski; 2nd, Lee that Resolution No. 24-92, be adopted.

Lee mentioned there were three items the Council was dealing with regarding this and asked what would happen if #19 was approved and for some reason #20 or #21 was not. (sold City property without having a Development Agreement or Lease Agreement).

Burnett stated the Council could hold all the Public Hearings first and then delay action until they were done and vote on all three in one motion. Motion, Lee; 2nd, Jaszewski to amend the Agenda to hold all three public hearings and following that take action on Item #19, #20 and #21 altogether. AYES: All (Motion carried.)

#20 Development Agreement – The Delaware, LLC: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections. There were none. Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized via Zoom. The Public Hearing was declared closed.

#21 Parking Lease Operating Agreement: The Public Hearing was held as per published notice. The Mayor Pro tem asked for comments or objections which were noted. Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized on Zoom. The Public Hearing was declared closed.

Motion, Jaszewski; 2nd, Latham that Resolution No. 24-92, approving disposition of City-owned property in the Mason City Downtown Reinvestment Urban Renewal Area, 24-93 approving Development Agreement Delaware, LLC authorizing annual appropriation tax increment payments and pledging certain tax increment revenues to the payment of the agreement and 24-94, approving a parking lot operating lease agreement be adopted. Discussion followed regarding the amount of parking downtown, how many spaces would be public parking, leased parking, notification, ownership of the parking lot, safety, etc. AYES: Jaszewski, Lee, Adams, Symonds. Nays: Latham, Masson (Motion was declared carried.)

Development Agreement Stellar Industries: The Public Hearing was held as per published notice. The Mayor Pro tem called for comments or objections. There being no comments, the Public Hearing was declared closed. Mayor Pro tem Adams asked if there were any written comments or objections with Administrator Burnett stating there were none and no one was seeking to be recognized on Zoom. There being no further comments, the Public Hearing was declared closed. Motion, Latham; 2nd, Masson that Resolution No. 24-95, approving development agreement with Stellar Industries, Inc. authorizing annual appropriation tax increment payments and pledging certain tax increment revenues to the payment of the agreement, be adopted. AYES: All (Motion carried.)
