Convicted Minnesota sex offender arrested in Franklin County sex crime

Convicted Minnesota sex offender James William Allen, age 62, was extradited back to Iowa on a Class B felony warrant for 2nd degree sexual abuse this week. The alleged sexual abuse occurred May 27th, 2012 in Hampton, Iowa. A warrant with a $50,000 cash only bond was issued for his arrest by District Court Judge Stephen P. Carroll on June 14th.

Allen was located and detained in Southern Minnesota before Franklin County law enforcement transported him back to Iowa to face the charge. Allen had an initial appearance to the charges on June 28th and was held on the original $50,000 cash only bond. I preliminary hearing is set for July 6th at 3:30pm.

James Allen is currently being held in a Special Status Cell at the Cerro Gordo County Jail.

Minnesota court records show Allen was charged with one count of 1st degree criminal sexual conduct and one count of 2nd degree criminal sexual conduct in 2000 in Watonwan County, MN. The court dismissed the more serious 1st degree count after Allen pled guilty to the lesser offence 2nd degree criminal sexual conduct. Allen served 10 months in Watonwan County Jail and was required to register as a predatory offender. Allen had been scheduled to serve 15 years on probation with an end date of May 22nd, 2016, but court records show he was let off of probation early in April of 2008.

Iowa Code 709.3 for sexual abuse in the 2nd degree defines the offence as a Class B felony punishable by a maximum of 25 years in prison if convicted. Sexual abuse in the 2nd degree falls under Iowa Code 702.11 as a forcible felony taking suspended sentences and deferred judgments out of the list of possible sentencing with a requirement to serve at least 70 percent of the maximum sentence if convicted.

SUBJECT IS INNOCENT UNTIL PROVEN GUILTY

  1. My heart goes out to the family as I know to well what this pervert is capable of. Prayers and speedy recover to the family and loved ones that this poor excuse of a human being hurt so badly.

  2. I think all sexual predators need to me hung and quartered….I think the system needs to listen to people, especially children, who have been sexually molested. There is no treatment or cure for a sexual predator and they will keep on doing it as long as they can. This is coming from a person who was sexually molested at the age of 8. What I spent on therapy, and what my children have spent on therapy would have gone a long way in financially benefiting us. What the government would save by euthanizing sexual predators would go a long way in benefiting our country. They have no human rights….all of this is from my own humble experience and opinion. Thanks for giving me the forum to express it.

    1. Why does the court system cut these sick !!!!!!’s any plea bargain at all??!!! So after 10 months the victim had to be scared all over again. Unbelievable. Way to cut him off paper EIGHT YEARS early!

      1. The worse part of him being let off the books after 8 years was the victim had to find out by looking it up on the internet. She talked to the probation officer and was told that he got off early for good behavior. He stalked his victim, had a no contact order and still got off! What is this world coming to?
