Son of North Iowa legislator arrested in Creston, Iowa

CRESTON, IOWA – Chad Randall Upmeyer, 37, was arrested on June 29th in Creston, Iowa and faces two charges: Lascivious conduct with a minor (709.14) and indecent exposure (709.9).

Both are serious misdemeanors.  If convicted, Upmeyer could face a year in jail and fines.

Upmeyer posted bond on Monday using Lederman Bail Bonds.

Chad Upmeyer is the son of Iowa House Majority Leader Linda Upmeyer.

SUBJECT IS INNOCENT UNTIL PROVEN GUILTY.

It’s been nearly 1-1/2 years and still nothing has happened with this case? Apparently Linda Upmeyer’s powers are such that she’s able to shut up all the Iowa media AND get the police to drop the case??

Just to get this straight — the Iowa GOP House Majority Leader has a son in his late 30s who has sex with kids. And the police and media are absolutely powerless to say anything in the face of that? Not even to report on what happened to the charges?

Disgusting that the news media has abdicated its responsibilities on this.

Maybe he was found innocent.

In which case, they can simply provide an update. Something like: “Despite the officers finding Chad Upmeyer in mid-coitus with a minor boy, the prosecutors declined to prosecute him because he had no idea what he was doing.” … or something like that.

As it stands in the media, the news of his arrest is everywhere but that’s where it ends.

Just think if his mom was a democrat. She would say “Chad, it’s okay.”

You’ve got to be kidding me. This is sex offender registry stuff. Wow. Linda Upmeyer? She’s like big whig Republican in these parts. Did I say Wow?

Indecent Exposure? Lascivious Acts with a Minor? I think we need more details. 17 year old girls are a way different story than 10 year old boys when it comes to sex crimes…however…

Ms. Upmeyer must be sick by the whole ordeal as it is a potential career buster for her. I better wait until more details emerge.

Never mind. I found the story in the Creston Newspaper report. I’ll reprint it here in italics.

According to a Creston Police report, officers were on patrol and located a grey Pontiac Grand Prix at McKinley Lake. Officers approached the vehicle and observed three males in the back seat of the car putting on their clothes. Officers checked the ID of Upmeyer and got the name of Nickell. Officers were told that two of the males were 18-years-old and Upmeyer was 37. Officers advised the lake closed at 10 p.m. and they needed to find another place to go. Upon further investigation, it was found that one of the males was only 16-years-old. Officers located Upmeyer, Nickell and the 16-year-old at his residence. After speaking with the 16-year-old, it was found that oral sex was given to Upmeyer and Nickell, and Upmeyer and Nickell gave oral sex to the 16-year-old. Statements were taken from all three individuals.

So it turns out Upmeyer is a homosexual and they traded giving and getting oral sex with the 16 year old. I’ll have to agree then, of the hypocritical family values supposedly infused by Republicans onto their children. It’s obvious such moral legislation doesn’t seem to be working. I wonder how Ms. Upmeyer voted pertaining to gay marriage bans. Her own son may need her support if he wants to get married later on.

But wait a minute…I thought the legal age of sexual consent in Iowa was 16 years. So if that is the case, why is it illegal for Upmeyer to have engaged in sex with the 16 year old?

709.14 LASCIVIOUS CONDUCT WITH A MINOR.
It is unlawful for a person over eighteen years of age who is in a
position of authority over a minor to force, persuade, or coerce a
minor, with or without consent, to disrobe or partially disrobe for
the purpose of arousing or satisfying the sexual desires of either of
them.
Lascivious conduct with a minor is a serious misdemeanor.

Basically it lists “position of authority” over the minor. So what is the position of authority Upmeyer had over the minor? Was he charged with watching the minor by the minor’s parents? More information needed. The indecent exposure charge is also suspicious to me as well. If they are inside a car and were all active participants, I’m not sure how police could charge him with this:

A person who exposes the person’s genitals or pubes to another not
the person’s spouse, or who commits a sex act in the presence of or
view of a third person, commits a serious misdemeanor, if:
1. The person does so to arouse or satisfy the sexual desires of
either party; and
2. The person knows or reasonably should know that the act is
offensive to the viewer.

I’m wondering if this was a case of homosexual badgering by the police. So far, I have not found any overt violations of the law. It seems they were all willing homosexual participants in a vehicle in a park after dark. It’s shocking to a degree, because it’s Linda Upmeyer’s son, but picking on queers is not okay in my book either.

I think Iowa Code needs to be clarified when it comes to all of the “age of consent” minor business. It’s either legal to engage in sex at age 16 or it’s not. There seems to be too much grey area and police are using that to their advantage to charge people.

The comment above was mine as well, I forgot to write my name. Basically this case hinges on whether or not all 3 of the males were active participants, and whether or not Upmeyer was considered in a position of authority over the 16 year old when he was with him in the car. “Position of authority” is a very vague claim. If a 25 year old man picks up a 16 year old girl from her home and takes her out on a date, does he now become her “authority”? I think the law puts this type of wording in, to basically give police the right to charge ANYONE over age 18 with a sex crime if they are with someone 16, but not yet 18. Basically I think the laws need to be re-written to just state age 18 as the age of consent, or to do away with the positions of authority clauses, or more accurately specify exactly what constitutes a position of authority. There’s also another charge of “contributing to the delinquency of a minor”, and I’m surprised Upmeyer wasn’t charged with that one as well.

I’ve always thought the sex laws were too vague and unclear to be considered fair. I think the label of sex offender should be reserved for people who engage in truly non-consensual rape type sex, and that it’s been way overused in our society.

It probably would be much simpler just to raise the legal age of consent to 18, as that is a number everyone feels comfortable with calling an adult an adult.

Linda Upmeyer has nothing to do with her 37 year old son sucking dick on a minor or even eating a teen pussy. That was his choice.

Linda Upmeyer seems to have something to do with covering up the story so that it has had absolutely no coverage in the media since he was arrested.

Must have been those high moral Republican famliy values he was raised on.
