January 2, 2025
The Board of Supervisors of Cerro Gordo County, Iowa, met in regular session pursuant to adjournment. Present:
Vice Chairman Chris Watts, Supervisor Casey Callanan, Supervisor Carl Ginapp, and various members of the
public.
Vice Chairman Watts convened the meeting at 10:00 a.m. Callanan moved with Ginapp seconding, to approve
today’s agenda and minutes for the December 30, 2024 regular session. Motion passed unanimously.
Public comment session was held.
Callanan moved with Ginapp seconding, to appoint Chris Watts as Chairman of the Cerro Gordo County Board of
Supervisors. Motion passed unanimously.
Callanan moved with Ginapp seconding, to appoint Casey Callanan as Vice Chairman of the Cerro Gordo
County Board of Supervisors. Motion passed unanimously.
Callanan moved with Ginapp seconding, to appoint the Board to act as committee for the purchase of supplies
and equipment. Motion passed unanimously.
Callanan moved with Ginapp seconding, to appoint Brandon Billings as County Engineer with his bond fixed
at $5,000 pursuant to Chapter 309.17 and 309.18.

Callanan moved with Ginapp seconding, to adopt Resolution 2025-02, WHEREAS, pursuant to the
provisions of Chapter 349.1, 1995 Code of Iowa, the Globe Gazette (North Iowa Media Group), and the MidAmerica Publishing Corp (Clear Lake Mirror Reporter) have made applications to be designated as official newspapers in Cerro Gordo County, Iowa, for the year 2025 for the publication of official board proceedings and all other legal notices; and, WHEREAS, no other applicants have been filed. NOW THEREFORE, BE IT RESOLVED, by the Cerro Gordo County Board of Supervisors that the Globe Gazette (North Iowa Media Group) published in Mason City, Iowa, and the Clear Lake Mirror Reporter published in Clear Lake, Iowa, are
hereby selected and designated to publish the official proceedings of the Board of Supervisors and such other notices as may be necessary for the year 2025. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt Resolution 2025-03, BE IT RESOLVED, by the Board of Supervisors of Cerro Gordo County, Iowa, that pursuant to the provisions of Section 331.506(3), 2005 Code of Iowa, the Auditor of Cerro Gordo County, Iowa, is hereby authorized to issue warrants in payment of claims against Cerro Gordo County when the Board is not in session for the following purposes:
1. For such fixed charges including, but not limited to, freight, express, postage, water, light, telephone services or contractual
services, after a bill is filled with the Auditor.
2. For salaries and payrolls if the compensation has been fixed or approved by the Board. The salary or payroll shall be certified by the officer or supervisor under whose direction or supervision the compensation is earned.
3. For reimbursements of elected officials, department heads, employees (who have been approved by their department head)
attending schools of instruction or seminars for which they have first paid the registration fees, please refer to Cerro Gordo County Policy No. 01-2019. Mileage will be compensated at the rate established by the Board of Supervisors with documentation.
4. Advance up to $500 cash to the Sheriff for out-of-pocket expenses anticipated in retrieving prisoners out of State with documentation of expenses required upon prisoner return.
5. For payment of fees for out-of-county
subpoenas and/or service of process by
the County Attorney’s Office when service
is necessary prior to the next Board
Session, but only up to $200 per fee.
This being authorized under the Board of Supervisors’
power of Home Rule (Attorney General opinion dated
May 19, 1994). Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-04, BE IT RESOLVED, by the Board of
Supervisors of Cerro Gordo County, Iowa, that pursuant
to the provisions of Section 331.323(2)(d), 2005 Code of
Iowa, each of the County officers is authorized to destroy
records in the officer’s possession which have been on
file for more than ten years and are not required to be
kept as permanent records. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-05, that in accordance with the
provisions of Section 12C.2, 2005 Code of Iowa, the
following named banks be approved as official
depositories for funds coming into the hands of the
County Treasurer for the year 2025. The maximum

Callanan moved with Ginapp seconding, to adopt
Resolution 2025-06, WHEREAS, the County Engineer
and the Board of Supervisors are jointly required to
cause the maintenance of the Secondary Road system;
and, WHEREAS, certain maintenance projects and
natural disasters present hazards to the public if
permitted to enter on the site of work of disaster. NOW
THEREFORE, BE IT RESOLVED, that the County
Engineer is authorized to temporarily close segments of
Cerro Gordo County Secondary Roads for heavy
maintenance functions and in the event of natural
disaster which causes the road or roads to be hazardous
to enter upon. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-07, BE IT RESOLVED, by the Board of
Supervisors of Cerro Gordo County, Iowa, that Brandon
Billings, the County Engineer of Cerro Gordo County,
Iowa, be and is hereby designated, authorized and
empowered on behalf of the Board of Supervisors of said
County to execute the certification of completion of work
and final acceptance thereof in accordance with plans
and specifications in connection with all Farm-to-Market
and Federal or State aid construction projects in this
county. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-08, WHEREAS, the following factors
shall be considered by the Board of Supervisors when
public funds are disbursed; and,
A. Businesses that add diversity to or
generate new opportunities for the Iowa
economy should be favored over those
that do not.
B. Development policies in the dispensing of
the funds should attract, retain or expand
businesses that produce exports or
imports substitutes or which generate
tourism-related activities.
C. Development policies in the dispensing or
use of the funds should be targeted toward
businesses that generate public gains and
benefits, which gains and benefits are
warranted in comparison to the amount of
the funds dispensed.
D. Development policies in dispensing the
funds should not be used to attract a
business presently located within the state
to relocate to another portion of the state
unless the business is considering in good
faith to relocate outside the state or unless
the relocation is related to an expansion
which will generate significant new job
creation. Jobs created as a result of other
jobs in similar Iowa businesses being
displace shall not be considered direct
jobs for the purpose of dispensing funds.
NOW THEREFORE, BE IT RESOLVED, that the Board
of Supervisors hereby approves this resolution on this
2nd day of January, 2025. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-09, Whereas, precinct election officials
have substantial responsibilities for the conduct and
integrity of elections in Cerro Gordo County; and,
Whereas, the County Auditor has recommended that
recognizing the public service of the precinct election
officials is in the public interest; now, Therefore, we find
that recognition of public service on behalf of the precinct
election officials in the form of expenditures for light
refreshments and tokens of service such as election
pins, coffee mugs, and items of a similar nature are a
public purpose. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-10, Whereas, Township Trustees and
Clerks have substantial responsibilities for the townships
in Cerro Gordo County; and, Whereas, the Board of
Supervisors has recommended that recognizing the
public service of Township Trustees and Clerks is in the
public interest; now, Therefore, we find that recognition
of public service on behalf of the Township Trustees and
Clerks in the form of expenditures for light refreshments
are a public purpose. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-11, WHEREAS, the Cerro Gordo
County Board of Supervisors has taken action to
reorganize county government; and, WHEREAS, those
actions have created a need for Board action concerning
authorized signatures. THEREFORE, BE IT
RESOLVED, that the Cerro Gordo County Board of
Supervisors hereby authorizes the following office head
or designee to submit for payment and sign for all claims
for payment against the county from the following
departments, and that the Board of Supervisors shall
sign for the departments which are shown as requiring
their signature below upon the review and advice of the
County Auditor:

Callanan moved with Ginapp seconding, to adopt
Resolution 2025-12, Whereas, Domestic Violence
Coalition Members have substantial responsibilities for
the training coordination, public awareness events, and
case investigation of domestic abuse and sexual abuse
in Cerro Gordo County; and, Whereas, the County
Attorney has recommended that recognizing the public
service of Domestic Violence Coalition Members is in the
public interest; now, Therefore, we find that recognition
of public service on behalf of the Domestic Violence
Coalition Members in the form of expenditures for light
refreshments are a public purpose. Motion passed
unanimously.

Resolution 2025-13, WHEREAS, acting pursuant to
Chapter 6B, 2005 Code of Iowa, the Board of
Supervisors of Cerro Gordo County, Iowa, do hereby

THEREFORE, BE IT RESOLVED by the Board of
Supervisors that the foregoing Resolution be adopted as
read and directs the County Auditor to certify a copy of
this Resolution to the Chief Judge of the Second Judicial
District. Motion passed unanimously.

Callanan moved with Ginapp seconding, to approve the
payroll register for period ending 12/28/2024. Motion
passed unanimously.
Callanan moved with Ginapp seconding, to approve
Change Order 2 with Wunsch Construction, Inc for
Drainage District 1 – Main Tile Repair. Motion passed
unanimously.
Callanan moved with Ginapp seconding, to authorize
Chair to sign Service Agreement with Rodney McKinney
for drainage services. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adopt
Resolution 2025-14, WHEREAS, Iowa Code section
459.304(3) sets out the procedure if a Board of
Supervisors wishes to adopt a “construction evaluation
resolution” relating to the construction of a confinement
feeding operation structure; and WHEREAS, only
counties that have adopted a construction evaluation
resolution can submit to the Department of Natural
Resources (DNR) an adopted recommendation to
approve or disapprove a construction permit application
regarding a proposed confinement feeding operation
structure; and WHEREAS, only counties that have
adopted a construction evaluation resolution and
submitted an adopted recommendation may contest the
DNR’s decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation
resolution the Board of Supervisors agrees to evaluate
every construction permit application for a proposed
confinement feeding operation structure received by the
Board of Supervisors between February 1, 2025 and
January 31, 2026 and submit an adopted
recommendation regarding that application to the DNR;
and WHEREAS, the Board of Supervisors must conduct
an evaluation of every construction permit application
using the master matrix created in Iowa Code section
459.305, but the Board’s recommendation to the DNR
may be based on the final score on the master matrix or
may be based on reasons other than the final score on
the master matrix; NOW, THEREFORE, BE IT
RESOLVED BY THE BOARD OF SUPERVISORS OF
CERRO GORDO COUNTY that the Board of
Supervisors hereby adopts this construction evaluation
resolution pursuant to Iowa Code section 459.304(3),
subject to the following procedures:
1. All applications to be reviewed under this
resolution shall be filed with the Executive
Assistant to the Board of Supervisors.
2. All applications shall be reviewed by CG
Public Health and the Planning and Zoning
Department prior to consideration by the
Board of Supervisors. CG Public Health
and the Planning and Zoning Department
shall file written reports with the Board of
Supervisors prior to the meeting at which
the application will be considered.
3. The Board of Supervisors shall hold a
public hearing on the application prior to
consideration of an application.
4. Notice of said hearing shall be mailed to
the owner of record of each dwelling
located within a two (2) mile radius of the
proposed confinement feeding operation
structure.

County Engineer Billings provided an update.

reports from the Environmental Health Service Manager
concerning Manure Management Plan Update for
Amaracon (The Red Barn) (site #65072) and forward to
the DNR. Motion passed unanimously.
Callanan moved with Ginapp seconding, to adjourn at
10:10 a.m. Motion passed unanimously.
Various tabulations, reports, correspondence and other
documents that were presented at today’s meeting are
placed on file with the supplemental minutes.
